Complaint What Happened I was informed by the Servicer numerous times that I was in Active Loan Review for a Loan Resolution thus I would be protected from foreclosure until a decision was made. As stated in the first paragraph of the Servicers letter. The letter clearly states : 'Therefore, we are prohibited from filing a new foreclosure action until your application is evaluated. If foreclosure proceedings have already begun on your property, we can not conduct a foreclosure sale before your application is evaluated. You also may be entitled to additional protections under State or Federal law. ' However, that was not the case. The auction continued to take place. I relied on their statements and what was written in their document to be truthful and honest. I feel like this was a modern day Land grab.

Complaint What Happened Dear Selene Finance, This letter is a formal response to Selene Finance 's reply regarding my claim that was sent on XX/XX/XXXX XXXX, through CFPB Claim XXXX. The claim addresses the inaccurate reporting of my mortgage loan term. Despite your claim that you have submitted the necessary information to the credit bureaus to correct this issue, it has been over 51 days from the date this claim was sent, and the issue remains unresolved. The inaccurate reporting of a XXXX ( XXXX ) year term instead of a XXXX ( XXXX ) year term has significantly impacted my credit report in the following ways : 1. Creditworthiness Perception : A longer loan term can be perceived as a higher risk by lenders, potentially affecting my ability to obtain new credit or loans. 2. Interest Accumulation : A longer loan term generally means more interest will accumulate over time, making it seem like I have a higher overall debt burden, which can negatively impact my credit score. 3. Debt-to-Income Ratio : The incorrect term affects my debt-to-income ratio calculations, which lenders use to determine my ability to manage monthly payments and repay debts. A higher ratio can make me look less creditworthy. 4. Payment History : The incorrect term might also affect how my payment history is reported, potentially leading to inaccuracies in reporting whether payments are made on time. 5. Loan Amortization : The amortization schedule for a XXXX ( XXXX ) year loan is different from a XXXX ( XXXX ) year loan, leading to discrepancies in how much of my payments are reported as going towards principal versus interest. 6. Future Loan Applications : When applying for new credit, lenders will review my credit report. An incorrect loan term might raise questions or concerns, potentially leading to higher interest rates or even denial of credit. Additionally, this inaccurate reporting violates the terms of my loan modification agreement. The agreement clearly states that the loan term was modified to XXXX ( XXXX ) years, effective XX/XX/XXXX. The failure to update the term duration on my credit report is a breach of this agreement. Furthermore, on XX/XX/XXXX XXXX, this inaccurate XXXX loan term was also disputed with the credit bureau, but Selene Finance confirmed to the bureau that it was accurate. This continued misrepresentation of my loan term is unacceptable and has compounded the negative impact on my credit report. The following laws have been violated due to this inaccurate reporting : 1. Fair Credit Reporting Act ( FCRA ) : Under 15 U.S.C. 1681s-2 ( a ) ( 1 ) ( A ), furnishers of information to consumer reporting agencies must not furnish information relating to a consumer to any consumer reporting agency if the furnisher knows or has reasonable cause to believe that the information is inaccurate. Additionally, under 15 U.S.C. 1681i ( a ) ( 1 ) ( A ), credit reporting agencies must correct or delete any inaccurate, incomplete, or unverifiable information within 30 days of receiving notice of a dispute. This was not done by Selene, despite your admission of the inaccurate reporting. 2. Real Estate Settlement Procedures Act ( RESPA ) : Under 12 U.S.C. 2605 ( e ) ( 3 ), mortgage servicers are required to provide accurate and timely information to borrowers. The failure to update the term duration on my credit report violates this requirement. 3. Unfair, Deceptive, or Abusive Acts or Practices ( UDAAP ) : Under the Dodd-Frank Wall Street Reform and Consumer Protection Act, it is unlawful for any provider of consumer financial products or services to engage in any unfair, deceptive, or abusive act or practice. Damages Sought Due to the inaccurate reporting and its significant impact on my credit report, I am seeking the following damages : 1. Additionally, I request that Selene remove the reporting of any late payments from my credit report due to the damage caused by this issue. Despite my previous communications, your response did not fully address my concern regarding the application of a {$2900.00} payment made on XX/XX/XXXX. Explain How the Loan Could Be Past Due from XX/XX/XXXX : Your response explained where the {$2900.00} payment was applied but did not address my specific concern. The statement shows that on XX/XX/XXXX, {$1300.00} was applied to the past due for XX/XX/XXXX, and {$1300.00} was applied to a past due balance for the due date XX/XX/XXXX, with {$170.00} unapplied. Your response did not explain how the loan could be past due from XX/XX/XXXX, when a payment was applied to that date. Shouldn't the loan be past due from XX/XX/XXXX, given that a payment was applied to cover XX/XX/XXXX? The point I'm making is that when the loan transferred to Selene, you claimed I owed from XX/XX/XXXX, meaning an extra payment was added, and the loan should not be 14 months past due but instead should be 13 months past due due to a payment already applied to cover XXXX. This means an extra {$1300.00} was added to the balance Selene claimed I owed. Furthermore, the XX/XX/XXXX payment of {$1300.00} should not be included in the amount that you claimed I owed at the time, which was {$19000.00}. Based on the information provided in my complaint, this payment was applied to cover the due date for XX/XX/XXXX and was not reversed. Therefore, it should not have been included in the outstanding balance, as it would have made the loan past due from XX/XX/XXXX, not XX/XX/XXXX. This means the loan is past due for 13 months, not 14 months. Selene Finance must explain why XX/XX/XXXX was included in the XXXX past due balance if the payment was already applied to that month, and why the XX/XX/XXXX payment of {$1300.00} was included in the {$19000.00} balance owed if the payment was already applied to XX/XX/XXXX. Your previous response confirms that the {$1300.00} went towards the XX/XX/XXXX installment and did not get returned. Violation of the Real Estate Settlement Procedures Act ( RESPA ) : Selene Finance 's actions also violate the Real Estate Settlement Procedures Act ( RESPA ), specifically Regulation X, Section 1024.34, which addresses the proper handling of escrow payments and the treatment of escrow account balances. This section requires servicers to manage escrow payments properly and prohibits them from netting remaining funds in an escrow account against the outstanding balance of the borrower 's mortgage loan without proper justification. By adding the extra payment of {$1300.00} to my loan balance, you have failed to manage the payments properly and have included an already applied payment in the outstanding balance, violating RESPA 's requirements. This mismanagement has led to an inflated loan balance and incorrect reporting on my credit report. Unfair Increase in Interest Rate : Like explained in previous claims, due to the inaccurate reporting and failure to investigate, I was forced into a loan modification that increased my interest rate from 3.75 % to 8 %, resulting in a {$970.00} increase in my monthly mortgage payment. If this issue was investigated properly, I could have afforded to pay off the balance of {$18000.00}, which should have been the true balance, which is the {$19000.00} balance minus the extra {$1300.00} that was added to the balance for XX/XX/XXXX. I just could not afford the extra {$1300.00} that they added to the XX/XX/XXXX balance they stated I owed at the time to prevent a loan modification that caused my interest rate to increase from 3.75 % to 8 %, resulting in a {$970.00} increase in my mortgage. This constitutes an unfair and deceptive practice under the Dodd-Frank Wall Street Reform and Consumer Protection Act, 12 U.S.C. 5531. Final Warning : I need Selene to stop ignoring the details and the point I am making in my claim. I know you understand my point but are refusing to admit that there was an error to protect yourselves. This is my final warning to Selene Finance : if this issue is not resolved, and the extra {$1300.00} is not refunded back to me due to Selene still including the XXXX payment in the balance you claimed I owed, even though it was already paid to cover that month, this issue will be explained in court. Selene Finance has 30 days from the above date, XX/XX/XXXX. If you fail to meet the deadline on or before XX/XX/XXXX, I will have no choice but to escalate this matter. I have already filed a claim with the Attorney General, the Department of Housing and Urban Development ( HUD ), the Federal Trade Commission ( FTC ), and the State Consumer Protection Office, and seek legal action. Additionally, I have submitted my complaint and Selene Finance 's response to the local police station for review. A police report will be filed against Selene Finance for reporting an inaccurate loan balance and inaccurate fraudulent loan terms that Selene Finance is fully aware of and admitted to reporting. Complaint What Happened I am writing to file a formal complaint against Selene Finance regarding their mishandling of our mortgage account and their failure to provide reasonable options for us to retain our homestead property. Their actions have caused significant distress and jeopardized our ability to keep our home. Prior to Selene Finance servicing our loan, the previous servicer, XXXX XXXX XXXXXXXX, had offered us a trial plan that was both feasible and agreed upon. However, upon the transfer of servicing rights to Selene Finance, they failed to honor the existing trial plan. Instead, we were compelled to apply for a loan modification, which was subsequently denied on two separate occasions. Furthermore : 1. No Response to Extension Requests : We sent multiple written requests to Selene Finance seeking an extension of the auction sale date. These requests went unanswered, leaving us without recourse or clarity on our situation. 2. Unreasonable Demands : When we contacted Selene Finance by phone, we were told that the only way to retain our home was to pay the full outstanding debt of {$85000.00} upfront, an amount we simply can not afford at this time. No alternative options or relief programs were provided, despite this being our primary residence and homestead. This lack of communication and refusal to provide alternative solutions violates principles of good faith and fair dealing, as well as potential regulations outlined by the Consumer Financial Protection Bureau ( CFPB ) regarding mortgage servicing practices. Given the impending auction sale date of XX/XX/year>, we urgently request the following actions : 1. An immediate postponement of the auction sale to allow for further discussions and review of alternative solutions. 2. A thorough investigation into Selene Finances failure to respond to our extension requests and their refusal to honor prior agreements made by the original servicer. 3. Complaint What Happened I have made multiple good faith attempts to pay this balance. Once in XXXX for a little over {$12000.00}. Sent via check that they never cashed nor was ever returned NSF. I had over $ XXXX in my checking account when I sent that check so the funds were good. That payment was sent in response to one of their regular monthly statements under what they categorized total amount to reinstate. The payment was sent well before the due date. If they would allow online payments after a person gets 60 days behind, this would not have been an issue. They cut off online payments so they can earn additional fees and late charges. Again I made a good faith effort to pay when I sent a bank wire on XX/XX/2023, per instructions from the Selene ( loan servicer ) representative, only to find days later that they returned the wire. No explanation. Here is the acknowledgement from my bank that the wire was sent. For account ending in XXXX : A Bank Wire disbursement from your account ending in XXXX to your bank was successfully completed on XX/XX/2023. Please remember that funds are made available based on your bank 's funds availability policy. If you have any questions or believe this is an error, please call XXXX. When I called back another representative agreed that she found the recording of the call where the previous agent gave me instructions to re-instate. She agreed that the wire was received on time, agreed that the amount was correct and the funds were deposited. She said unfortunately they did not process the payment because a reinstatement letter had not been sent so my payment was rejected. Now they want {$31000.00}. This includes {$230000.00} principal and interest which I am not disputing. They also want me to pay an additional {$8300.00} for fees incurred by them because of their loan servicing agent 's failure to accept payment. Complaint What Happened Selene Finance is the mortgage company that I have a loan with. I have been trying to get a loan modification with them. All documents were sent several months ago.They have used stalling tactics to keep our loan from reaching the underwriter. We have have documented date times and duration of every call and it is pure waste of time. It is as if these folks are not trying to help customer in need of mortgage assistance on purpose. All required documents have been sent. Yet they continue to string us along to this day as we approach the deadline for the file to be reviewer. When we ask for managers or escalations, we are dumped right back into the queue for calls to start over. We have been put on hold for infinite amounts of time. One of the supervisors name XXXX XXXX informed me that I would get a call back from the escalation team and no one returned the call. She claimed that she would write a letter of complaint of my behalf to the ombudsman and I explained that his would be a conflict of interest if such a department existed. Their business practices are very shady and how they handle customers is terrible. I feel bad for anyone who has to put up with the treatment they get. The level of customer service is terrible but the stalling tactics are in violation of many laws and this is why I decided to file a complaint here. I hope CFPB Can address these issues as I have documentation to support my claims. If you are dealing with Selene Finance, please logged date and times of all calls, names of people you speak to and their supervisors. There seems to only be one that keeps taking our calls.

Complaint What Happened Re : Selene Finance Mortgage loan # XXXX I was the primary borrower on a mortgage loan with Selene Finance. The co-borrower on the loan, my mother, passed away before the loan was paid off, she was also a widow. I paid the home off XX/XX/2022. The escrow reimbursement check was issued by Selene Finance XX/XX/2022, and sent to me in both names. Because my mother died with no assets, no will and no bills, the XXXX XXXX FL probate office refused to open probate or an estate and appoint an administrator as there was no need. My warranty deed to the property for which the mortgage loan was granted, is a survivorship deed granting any owner/co-owner of title the right of survivorship and property in case of the death of any co-owners without circumstance from other family members or persons who would feel they had claim to the deceaseds assets. In light of all this, On XX/XX/2022, I returned the check and included a certified copy of her death certificate and a letter of explanation and request, asking Selene Finance to reissue the escrow check in my name alone as it could not be cashed with her name on the check. The documents were received by Selene Finance on XX/XX/2022. To this date of XX/XX/2022. I have not received a new check. I have emailed Selene Finances customer service department multiple times only to get form letters back by postal mail stating they received my communication and by law they had 30 days to respond but with no updates or explanations. Thats all that I have received back to date. I have called customer service multiple times only to stay on hold 30 mins or more and then be disconnected. I feel that nearly 5 months is way more than long enough for Selene Finance to have reissued the check with the evidentiary document presented to them and the original check back in their possession. At this point, they are in possession of money ( {$1100.00} ) that does not belong to them but belongs to me, and it seems they are refusing to cooperate ( even in response to the possibility of legal counsel involved ) with the request of the reissuance of the check in my name alone. This neglectful or willful inaction and uncooperativeness could be construed as theft. It may not seem like a lot of money to them but it is to me because it is needed to pay my property taxes for the 2022 tax year.

Complaint What Happened My father passed away and left me the home. I kept paying the mortgage and everything was going well. I fell behind on the mortgage XXXX, XXXX. Since then, I have been attempting to get the loan into my name and the mortgage modified. I could not get anywhere with XXXX so I hired a law firm XX/XX/XXXX. Since then my law office has collected multiple documents from me. I have been told that I have sent in the wrong application 4 times. I have sent in 5 applications and many supporting documents. My review keeps getting closed out and my lender is not advising counsel of my attempts to bring the loan current and telling their counsel I am not trying to save the home. This time I called on XX/XX/XXXX and I was told I needed to send a profit and loss, tax returns and a letter of explanation. The profit and loss and letter of explanation were sent on XX/XX/XXXX, the taxes sent on XX/XX/XXXX. Today, XX/XX/XXXX I called to check loss mitigation status and I was told the review closed out yesterday. I inquired as to why and I was told the letter does not say and so she doesn't know. Also, today the lender 's attorney sent an email that states " I do not see our office or our client have received any documents to review the loan for Loss Mit '' This is completely false as I have been attempted to be reviewed for over 2 years. I am unable to get a single point of contact to make sure all documents are in. Every time my review gets closed out I speak to a supervisor who says they will fix it however this keeps happening. I am now at risk of paying out of pocket for mediation, which I do not trust will be successful. If the lender 's loss mitigation department would review mediation would not be necessary. I would really like the servicing of this loan to be investigated as I do not feel that I am being treated fairly. My loan is XXXX XXXX and I know there are programs to help me. Thank you.

Complaint What Happened Selene Finance has been reporting that my payments are not being sent on time. I have made several attempts to clear this with Selene with not help from them. I have record of all my payments and the 3 extra payments made so I can stay ahead of the game. I am in the middle of loan and this has held me up with my company financing. My mortgage payment was {$1700.00} with three percent interest. XX/XX/2022, I called Selene Finance to follow up on loan modification status. Representative advised my modification has been approved. On XXXX XXXX, I received in regular mail, and a certified copy of Notice Of Default and Intent For Acceleration.Selene has only had my loan for barely 3 months which I was not completely in the system. On XXXX XXXX, I contacted Selene and stated that I wanted to make payments online. I was told that I could not make payments online because I was not in the system, due to the transfer not completed. I made two payments on XXXX XXXX, please keep in mind that my due date was moved to the XXXX of every month and this request was granted by my previous lender XXXX XXXX, therefore I have a 15 day grace period from the XXXX to the XXXX to pay the mortgage. Selene Finance had generated a Notice Of Default and Intent For Acceleration for two months and escrow balance which is illegal.Mortgage lenders can exercise their right only generate a Notice Of Default and Intent For Acceleration for 3 months of unpaid mortgage, not escrow that no longer exist due to I canceled my escrow account with my previous lender XXXXXXXX XXXX. I am not delinquent on my taxes or my homeowners insurance.On XX/XX/2022, contacted Selene Finance and spoke to XXXX in customer service pertaining to the Notice Of Default. I asked XXXX about the Notice and was told my account is current and please disregard the notice.XXXX also told me that the company can not file a Notice Of Default for an non escrow account and it was illegal. I was already knowledgeable about this, and requested to have the disregard letter in writing, but was told I would have to write a request letter for the disregard letter in writing instead of verbally told over the phone by her. I also ask her if Selene Financing has an Ombudsman department and I would like to be transferred there.XXXX stated to me yes, but I would still have to put it in writing.

Complaint What Happened I tried to stay current on my mortgage during the pandemic however I fell behind in XXXXXXXX XXXX. My loan was transferred to Selene finance and they put me into foreclosure. I have an FHA loan and Selene did not tell me assistance was available. They did not offer me any assistance nor did they inform me of the programs that FHA had put in place for homeowners like myself. Every time I tried to get information regarding the FHA partial claim or recovery modification I was told I had to send in an application with full documentation. I am now in foreclosure and incurring fees and lawyer costs without even being informed that I could have gotten a streamline through FHA and been helped. I think Selene has violated the CARES act by blocking me from assistance and then putting me into foreclosure. The COVID pandemic was horrible and I do not think I should lose my home. Especially if there is available assistance and Selene blocked it.

Complaint What Happened I have been in contract with XXXX XXXX to correct the problems with my account. I received a letter that said my credit scores would be adjusted and that has not happened. On my statement they are still showing erroneous late fees.. When Selene erroneously force place insurance on my account it generated additional late fees including inspection and other junk fees. I requested that they review my account and make adjustments to the late fees. There was extra money paid on my account which that they are holding. I asked that they apply the funds that they are holding to the late fees and then give me the balance to be paid. I spoke to one of their phone reps and she told me the excess funds could not be applied to my account until it reach a full mortgage payment and then it would be applied to the mortgage payment. I told her I want the excess to be applied to the late fee regardless of their policy ; after all it is my money.. I am paying 15 % interest and applying that money to a payment does not help me because of the {$760.00} payment only {$17.00} is going towards principle. The other thing I have requested is that when I request a payoff statement the the statement " Our records indicate the above reference mortgagor ( s ) is/are either in bankruptcy or has/have received a discharge in bankruptcy '' be remove as it brings up a red flag and impedes my ability to refinance the property. That is false and misleading information Selene is providing to other lenders. Their practices hurt the consumer.

Complaint What Happened I have submitted numerous modification packets since account was transferred to Selene Mortgage Co in XX/XX/XXXX. They initially sent me a welcome letter and vocher saying first payment had to be sent by certified check. I had my credit union do that. Several months later that check and a letter was return stating I was in forclosure when acct was transferred to them and they needed to modify the acct and to complete a packet. i did and they adjusted my payment. i had a XXXX emergency after third payment and called to let them know i will be several weeks late with payment and said it was ok just pay before the end of month. Within 3 weeks i got a letter saying they could no longer honor the modification agreement and the predatory practices started. i was told i could no longer make payments, constantly sent letters to complete modification packets which i did ; phone calls went unanswered, could not go online, received a statement once in a while, started getting people showing up at my home to take pictures but at the same time my balance is increasing with all kinds of charges. I developed XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. I never had XXXX XXXX. I had a legal claim against my homeowners insurance company for hurricane damage to my home. once the case was settled Selene took control of money but was able to fix some of my home problems. I used saved money to fix mostly the rest of my home over time. Now I'm in pending foreclosure with courts. I have been through every class action law suit with all the mortgage servicers that is under the same main company ( XXXX, XXXX, XXXX, XXXX and now Selene ). In XX/XX/XXXX XXXX XXXX paid $ XXXX to get the mortgage arrears corrected with Shellpoint but the money was never applied to my account. They later filed for bankruptcy. I'm still in a foreclosure status. I've always been able to pay my mortgage but never been allowed to due to predatory practices. Since this has been going on for over 5 years, my case falls under the Florida Statue of Limitations for foreclosure and should be closed.
