Description | Order-Original Proceeding Dismissed ~ ORDERED that the petition for writ of certiorari is dismissed. See Power Plant Entertainment, LLC v. Trump Hotels & Casino Resorts, 958 So. 2d 565 (Fla. 4th DCA 2007); Romanos v. Caldwell, 980 So. 2d 1091, 1092 (Fla. 4th DCA 2008). The trial court did not abuse its broad discretion over discovery by granting a temporary stay of depositions in order to maintain the status quo. No departure from the essential requirements of law or irreparable harm for certiorari jurisdiction is shown. Counsel Chris Kleppin’s argument that his filing of a petition for writ of prohibition in this Court precluded the trial judge from acting or granting a temporary stay of the depositions is frivolous. The filing of an extraordinary writ petition does not automatically stay the proceedings below or deprive the trial court of jurisdiction. See Fla. R. App. P. 9.100(h).Since 2015, counsel Chris Kleppin has now initiated at least fifteen extraordinary writ proceedings in this Court relating to the underlying case and related cases involving this petitioner, including eight this year alone. Case Numbers 4D15-974, 4D15-986, 4D16-931, 4D16-1998, 4D16-1999, 4D16-2214, 4D16-3780, 4D17-1925, 4D17-2344, 4D17-2882, 4D17-3061, 4D17-3142, 4D17-3288, 4D17-3289, and 4D17-3290. A number of these cases have been dismissed for failure to establish irreparable harm for certiorari jurisdiction. E.g., 4D15-974 and 4D15-986. Despite these dismissals in 2015, less than a year later, counsel Kleppin filed two more certiorari petitions seeking review of the same issue. 4D16-1998 and 4D16-1999. Those petitions were dismissed for lack of jurisdiction as well. Despite often having a number of related cases pending simultaneously in this Court, counsel Kleppin has consistently failed to file a notice of related cases as required by the Notice to Attorneys that is served on counsel with each acknowledgment of new case. Invariably, counsel Kleppin’s filings are filled with irrelevant information and unnecessarily long. Review of frivolous pleadings wastes this Court’s limited judicial resources. See Dubowitz v. Century Vill. E., Inc., 381 So. 2d 252, 254 (Fla. 4th DCA 1979). Counsel’s pattern of filing meritless or frivolous petitions, such as the petition filed in this case, demonstrates an ongoing abuse of process. Counsel is advised that this Court is not a forum to attempt to “micromanage” the underlying cases.Further frivolous filing in this Court may result in sanctions, including referral to the Florida Bar. See Fla. R. App. P. 9.410(a).WARNER, GROSS and CIKLIN, JJ., concur. |
