ORD-SUA SPONTE ~ Global Leaf Energy, Inc. (Global Leaf) appeals the trial court's entry of summary judgment on count one of a three-count complaint filed by Khalid Mohammed A. Al-Atteyah (Al-Atteyah). The court's grant of summary judgment was reduced to a "final judgment" on count one alone. Count one seeks damages against Global Leaf under a breach of contract theory. Counts two and three—both denominated as fraud claims—relate to the same underlying transaction as count one but seek the alternative relief of rescission.From a review of the record and the briefs, Al-Atteyah appears willing to forego any right to rescission and to seek money damages instead. Accordingly, we relinquish jurisdiction to the trial court for 30 days to permit Al-Atteyah, consistent with his representations on appeal, to move to voluntarily dismiss the remaining two counts and for the trial court to render a judgment disposing of all three counts of the complaint. The clerk of the lower tribunal shall supplement the record within ten days of the entry of a judgment disposing of all counts. No further order shall be needed for supplementation.The parties shall file a status report within 35 days of this order.
