ORDERED that Appellant shall show cause in writing, if any there be, within ten (10) days from the date of this order, why this appeal should not be dismissed for lack of jurisdiction. Appellant shall address how the April 27, 2023, "Motion for Reconsideration of the Order Denying Defendant's Motion to Vacate the Court's Order of November 16, 2023" tolled rendition of the April 21, 2023, Final Default Judgment, as it appears to be a motion for reconsideration aimed at the November 16, 2022, "Order Dismissing Defendant's Counterclaim and Entering Default Against Defendant" rather than the Final Default Judgment, and such motions aimed at nonfinal orders do not suspend rendition of final judgments. See Fla. R. Civ. P. 1.540(b) ("A motion under this subdivision does not affect the finality of a judgment, decree, or order or suspend its operation.") (emphasis added); Seigler v. Bell, 148 So. 3d 473, 479 (Fla. 5th DCA 2014) ("Nomenclature does not control, and motions for either "rehearing" or "reconsideration" aimed at final judgments shall be treated as rule 1.530 motions for rehearing, while motions aimed at nonfinal orders shall be treated as motions for reconsideration.").
No response is required from the Appellees unless provided for by further order.
