Description | Order Denying Petition for Writ - Prohib. ~ ORDERED that the petition for writ of prohibition is denied, as the motion to disqualify was legally insufficient. Disqualification was not required because of the former relationship between opposing counsel and the judge, because opposing counsel withdrew from representation prior to filing anything in the proceeding on which the judge would have to rule. This case thus differs from City of Fort Lauderdale v. Palazzo Las Olas Group LLC, 882 So. 2d 1102 (Fla. 4th DCA 2004), where the withdrawn attorney, who was the judge’s personal counsel, had filed the petition required to be reviewed by the judge. The remaining allegations of the motion and this petition, based on the judge’s frustration with the case, and adverse rulings regarding scheduling, do not give rise to a well-founded fear of judicial bias.CONNER, C.J., WARNER and KUNTZ, JJ., concur. |
