Grant Miscellaneous Motion-79 ~ This is an appeal of a final judgment in a civil case. Appellant's amended motion to determine confidentiality is granted pursuant to Florida Rule of Judicial Administration 2.420(c)(9)(A)(vi)-(vii). Pursuant to the parties' confidentiality agreement, Exhibits A through D to the prenuptial agreement filed with Appellee's motion to supplement the record are confidential and are to be kept under seal in this appeal. The court finds that no less restrictive measure is available to protect the confidentiality of these items and that the degree, duration, and manner of confidentiality ordered herein are no broader than necessary to protect such confidentiality. No party's name is determined to be confidential, nor are the progress docket or similar records.The clerk of this court shall seal the exhibits identified above and keep them from public access. Only the parties and their counsel, the judges of the court, and the court staff may view the materials determined as confidential by this order.It is further ordered that, within 10 days from the date of this order, the clerk shall post a copy of this order on the court's website for a period of 30 days to provide public notice.

ORD-DENYING REHEARING ~ Appellee's motion for rehearing and motion for rehearing en banc are denied. Appellant's response is noted.Appellee's motion to supplement the record is also denied. Appellant's motion to determine confidentiality is denied as set forth below. Appellant's motion does not sufficiently comply with the requirements of Florida Rule of Judicial Administration 2.420 to allow us to determine the confidentiality of the financial exhibits and schedules to the prenuptial agreement. See Fla. R. Jud. Admin. Rule 2.420(e)(1) ("A request to determine the confidentiality of trial court records in noncriminal cases under subdivision (c) . . . must . . . set forth the specific legal authority and any applicable legal standards for determining such court records to be confidential . . . [and] include a signed certification by the party or the attorney for the party making the request that the motion is made in good faith and is supported by a sound factual and legal basis."); cf. Barron v. Fla. Freedom Newspapers, Inc., 531 So. 2d 113, 119 (Fla. 1988) ("The parties seeking a dissolution of their marriage are not entitled to a private court proceeding just because they are required to utilize the judicial system. Dissolution proceedings are regulated by statute and are unique because the state is considered an interested third party to protect the public welfare. While Florida, as a matter of public policy, has expressly made certain civil proceedings confidential . . . and some states have enacted legislation limiting public access to divorce proceedings . . . , the Florida Legislature has chosen not to do so. We conclude that dissolution proceedings must be treated similar to other civil proceedings, and thus the presumption of openness applies."); Friend v. Friend, 866 So. 2d 116, 117 (Fla. 3d DCA 2004) ("[I]t is evident that the trial court sealed the dissolution action based solely on the parties' agreement. The denial of access to dissolution of marriage proceedings may not be based solely upon the wishes of the parties to the litigation."). This denial is without prejudice for either party to file a motion or amended motion that complies with Rule 2.420 and specifies the legal bases to justify maintaining the exhibits and schedules to the prenuptial agreement attached to Appellee's motion as confidential within ten (10) days of the date of this order.
