Universal American Mortgage Company , LLC ( UAMC ), committed multiple violations of CFPB and Federal Regulations during my evaluation for Loss Mitigation Workout options. The application contained inaccurate financial information, which differed from the evidence submitted and was not discovered or properly reviewed. There was a violation of dual-tracking as well. After being denied for Loss Mitigation Workout, I appealed the decision within the allotted time ( 30 days ). While reconsidering loss mitigation options following the acceptance of my appeal, UAMC 's lawyers submitted a Motion for Judicial Sale of Property. The excuse I received from UAMC 's Foreclosure Department was a lack of communication between their department and the Loss Mitigation Department. Their lack of communication resulted in my appeal being denied on XX/XX/XXXX, and a sale date of XX/XX/XXXX. Now I have 6 days until the sale date and UAMC is refusing to rectify the situation.

XXXX and XXXX were in the process of buying a property in XXXX, Florida. The process started around the beginning of XX/XX/XXXX and lasted until XX/XX/XXXX. The mortgage company was Universal American Mortgage Company ( UAMC ), and the loan officer that handled the loan was XXXX. The entire process lasted around 4 months. It lasted so long that we needed to provided the same information ( updated ) over, and over again. XXXX was XXXX, she was put on XXXX around XX/XX/XXXX. She had a XXXX on XX/XX/XXXX and was put on bed rest as well, she was XXXX weeks XXXX. Her XXXX was going to last until the XXXX which was going to be around XX/XX/XXXX. Because of her XXXX on XX/XX/XXXX she was put on bed rest until further noticed from her doctor. Because of the length of the approval process UAMC requested new payments information on XX/XX/XXXX. UAMC saw different numbers from the ones they saw around XX/XX/XXXX. XXXX and XXXX informed UAMC ( XXXX ) that XXXX was XXXX, that she was put on XXXX by her employee, and that she had a XXXX on XX/XX/XXXX. UAMC told us that they were going to disapproved the loan because of XXXX being on XXXX, best rest, and because of that reason she was going to make less money. UAMC told us the only way they will approved the mortgage loan was only if XXXX returned to work, provide proof of she being back to work, and also provide proof of her new payment information. XXXX did n't have other option than cut her bed rest and return to work by the end of XX/XX/XXXX. XX/XX/XXXX was forced to returned to work under pain medicine in order to get the loan approval by UAMC.

We placed a contract on a new construction spec home owned by XXXX. At the time, our current home was under contract ( cash deal ) and we had to close in 3 weeks. The realtor at XXXX did not make the sales contract contingent on the sale of our home, but instead made it contingent on our ability to obtain financing within 30 days. He also suggested that we put down a hefty binder deposit of XXXX to secure this new home. We did.
Two days after signing the contract for the purchase of our new home with XXXX, our buyers backed out of the deal to purchase our existing home. This left us with XXXX choices if we still wanted to move to the XXXX XXXX. 1. Put our house back on the market ASAP or 2. Rent out our current home. After doing much analysis on market conditions, etc.. we decided that we did not want to do either, and we would just remain in our current home and get denied on the new construction XXXX XXXX based on the fact that we ca n't qualify for both payments.
My husband and I have been in salaried jobs for 20 years and we are still in those jobs. However, in the past 3 years, we opened a business which has sustained significant losses. When submitting the documentation for our loan, we provided tax returns showing these losses over the past two years.
Our initial ( verbal ) loan approval was based on the requirement that we would either need to rent or sell our current home. We told that that we wanted to do neither and we submitted our official Notice of Cancellation and asked that they return our {$10000.00} earnest money check. The very next day, we get a call from UAMC ( XXXX 's mortgage company ) saying that they are overlooking the losses on our tax returns and that we are approved carrying XXXX mortgages.
Based on this unconditional loan approval, we have XXXX options : 1. We close on the new home or 2. We lose our earnest money deposit or 3. XXXX holds the earnest money for 12 months and we buy another XXXX XXXX.
Our issue with this is that we KNOW we ca n't afford our current mortgage plus the new mortgage based on our current ( and sustained ) business losses. They are forcing us into a financial situation that we ca n't afford and that significantly worsens our financial position. Our Debt to Income ratio without counting our business loss is roughly 37 %. Our Debt to Income ratio while counting out business loss is roughly XXXX %. I know that the XXXX standard for DTI max is XXXX %. We greatly exceed that DTI when our tax returns are factored in. We do n't understand how a lender can 'overlook ' a two year average of almost {$65000.00} in business losses, and therefore force us to purchase a home that they KNOW we ca n't afford.

During mortgage application period with Universal American Mortgage Company ( UAMC ), i constantly instructed my loan officer to lock in my interest rate. he always refused, had an excuse on why he could not lock it. at one point even said he could not lock it because the market was so bad it was shut down. eventually time passed and interest rate rose. 2 weeks from closing or less he eventually locked me in at XXXX i should have been locked in at XXXX a month before that considering my credit score is XXXX additionally original documents showed origination fee of {$6000.00} total. at closing time it was changed to {$4000.00} origination fee and {$2000.00} point to reduce interest rate. i understand the totals did not change but the manipulative, financial engineering was dissatisfying and should be investigated. i was never told i would be paying for points and did not have a reason to pay to reduce points. considering the importance of purchasing the house and time restraints i still signed the documents and closed on the house.

For several months, bills from Universal American Mortgage Co., LLC have been delivered to the attention of the deceased prior owner of a condo I purchased in foreclosure from XXXX XXXX in XXXX 2015. Today XXXX addressed to me arrived, claiming I owed a balance of {$7100.00}. Contact with the company revealed that they had no documentation supporting their supposed " deed loan ''. My review of the closing documents failed to reveal any disclosure of such a loan. I have no intention of paying this loan and am concerned that my credit record will be affected negatively.

The sales person at XXXX XXXX, told me that XXXX affiliated mortgage company, Eagle Homes would match any interest rates of other mortgage companies. I decided to purchase this home based on the fact that I would receive {$20000.00} in closing costs and upgrades if I went through Eagle Home and they would provide fair interest rates, comparable to other lenders. I was hesitant knowing they are affiliated companies because I was unsure they'd provide a fair rate. The sales person explicitly told me that they would match any other lender. With that as my understanding, I signed the purchase agreement. At this point, with two weeks out, with the average national interest rate at 3.7 %, Eagle Homes attempted to offer me 4.25 %. I have good credit and 20 % down. I went to XXXX XXXX they offered 3.6 %. XXXX said they would take away my builder incentives if I didn't go with Eagle Homes. However, Eagle Homes is clearly trying to take advantage of there customers. I asked Eagle Homes to provide a reason as to why the interest rate is so much higher than there competitors with no response.
I gave them a chance to match and they only went down to 3.99 %. Again, higher than the national average and not near XXXX, forcing me to go with Eagle Homes or lose the incentives. I have no problem using XXXX lender but they are clearly steering me to a lender with unfair rates and requiring me to use there lender to buy a house I would not have chosen to afford without those incentives I had before I signed the contract. XXXX and Eagle Homes have done little to nothing resolve the issue at hand. It looks like Eagle Homes and XXXX are forcing me to use a lender or lose $ XXXX in incentives while trying to make back the $ XXXX by charging me high and unfair interest rates.

Eagle Home Mortgage is completely taking advantage of first-time home buyers by not being timely and transparent with important information regarding the interest rate and mortgage payment as a result of the interest rate.
When I was in the process of getting pre-qualified for the USDA loan, I specifically told the representative from Eagle Home Mortgage that I wanted around my payment to be around the low-to-mid $ 1600s. When he presented the cash-to-close to me when I was considering to purchase the house, he put it at a 4.25 % interest rate for USDA. I fought back on the interest rate because I went to competitor builders the same week, and I was being quoted 3.89 % based off my credit score. In addition, the house from the competitor was $ XXXX more expensive, had equivalent HOA + CDD fees combined, but is the same mortgage as what Eagle Home Mortgage quoted me. However, XXXX, the representative, said he was being honest with me and the other company was lying, and that if I get the interest rate around 3.8 %, then my payment would be where I want it to be. As a result, I purchased the house.
I am aware that interest rates change, but throughout the past few months since I bought the house, I would ask my lender to check the interest rate and see what it is so I know what a realistic payment is, instead of the worst-case-scenario he advised me on. He kept refusing to look and said he won't even consider looking until the end of XX/XX/XXXX/beginning of XX/XX/XXXX ( the house closes in XX/XX/XXXX ). I wanted to know what I am getting offered from Eagle Home Mortgage since I have to use them to get all my closing costs paid. I wanted to know if their offer is competitive so I have time to shop around if need be and just put the closing costs in the mortgage, but since they kept delaying on telling me, I had nothing realistic to compare to to see if I'm honestly getting a fair deal.
I am now less than 30 days from closing, and it took me constantly messaging the lender and my sale 's agent at XXXX to finally get Eagle Home Mortgage to disclose the rate today ( XX/XX/XXXX, closing is on XX/XX/XXXX ), and I was told that it was 4.12 % with the mortgage payment being {$1700.00}. He said that if I use the cash I get back at closing and they contribute {$2000.00}, I can get the interest rate to 3.8 %, but the payment would only be {$54.00} less. The lender then disclosed to me today that it would take a significant drop in interest rate to get the payment to where I want it to be, which I was completely upfront about to begin with. As a result, I am now in an extremely bad situation by that I lose {$2000.00} if I cancel the house, and I no longer have time to shop around with other lenders to get a lower interest rate without taking the risk of adding fees from XXXX if the outside loan is approved after the closing date. I did talk to another builder today, the same day Eagle Home Mortgage told me my interest rate, and with my credit score, I was told I can get a 3.625 % interest rate ( with no money required to buy down the rate ). It is appalling that two lenders can take the same credit score and same loan type, and come up with interest rates that differ by 0.6 %.

The loan approval process through Eagle Home Mortgage , LLC an affiliate of XXXX XXXX has been nothing short of a nightmare. The loan was issued with a cosigner. The amount of information that was being requested by the " underwriting '' process was above and beyond what was actually needed. The amount of information that was submitted to multiple loan officers with this company that was lost, not uploaded to underwriting, or requested in so many different forms that it has prolonged the actual loan approval for a closing that was dated XX/XX/18. The dates for closing have been changed so many times, up to the last issue we've encountered. We were set to close tomorrow XX/XX/18 and never sent a corrected closing disclosure until XXXX XXXX the evening before. ( XX/XX/18 ). Upon review it was noted that the insurance company/premium was incorrect. Looking back in emails the updated information was sent to loan officers on XX/XX/18 and XX/XX/18 that the insurance company had tried several times to contact with no success. Why on the eve before closing, in a closing disclose we are required to have 3 days before, is the insurance information not corrected when myself sent it to them ... this is the question we all have! Now due to their incompetence we yet again have another issue with the dated closing being not adhered to. The required by law closing disclosure has yet to be received at XXXX XXXX the evening before we are set to close. We have received NO final corrected closing docs, NO title company info, NO downpayment final number, and the loan officers are no longer taking our phone calls. Total incomplete and better yet I feel that my private information is being used against the final approval of this loan/mortgage. The last contact we've had with the loan officer led to a insult due to a job vacancy in the middle of this loan process and was handled in the most unprofessional manor.

We have recently refinanced our home through eagle home mortgage. We used them when we first bought our home in XX/XX/2018 and our mortgage was transferred to a company called XXXX XXXX XXXX. Eagle home mortgage let us know that since it was tax season that our taxes would not get taken out of our escrow account but we would have to pay this up front which would require us to pay out of pocket over {$8000.00} but in doing so we would receive our total escrow balance which was around {$5500.00}. We made this very clear with eagle home mortgage since this was a lot of money we would have to pay out of pocket that we would need back. They reassured us that it would be fine and we would receive the {$5500.00}. We finally got the check from XXXX XXXX XXXX today for a total of {$1200.00}. I have reached out to Eagle home mortgage today by email as well as XXXX XXXX XXXX and awaiting their reply.

I received the final closing disclosure with a huge variance in the escrow account.
On XX/XX/XXXX the escrow account is {$1000.00} On XX/XX/XXXX the escrow account is {$3300.00} ( This is the final closing disclosure before the closing date ).
Due to the construction delay of the house I purchase, my closing date has been changed at least 3 times. Now when the house in almost done, with the fact that the XXXX company urges me to close as soon as possible while there is a huge difference in my monthly payment and escrow account, I do not feel comfortable to close this house ; especially when they threatened me that I have to pay for the penalties.
I completely feel disrespected and deceived by XXXX the home builder, Eagle Home Mortgage, and XXXX mortgage closing company.

We recently used Universal American Mortgage Company ( UAMC ) that is owned by the builder XXXX. It was overall a poor experience, however we had XXXX issues that were concerning and unethical. The first issue was misrepresentation by the loan officer XXXX XXXX. When she pulled our credit for the loan she told us that my credit score had gone down and we would have a higher interest rate and MIP. This was incorrect - no credit score had gone down, XXXX of the credit reporting bureaus was not reporting and they would have to use a lower score. This resulted in a significantly higher monthly payment than previously estimated.
The second issue was with the loan processor - XXXX XXXX, who is used by UAMC to process their loan appliactions. They required my husband to call the credit card company and required him to disclose his full credit card number and the answers to the security questions with the loan processor on the phone. If he did not disclose this information then they threatened to deny our loan.
The final issue was that UAMCXXXX pulled my husband 's credit without authorization. When the issue was resolved with my credit regarding the credit bureau that was not reporting a credit score, it was agreed with the loan officer 's supervisor XXXX XXXX that they would pull my credit score. It was very clear that only my credit would be pulled and not my husband 's. UAMCXXXX pulled both my credit and my husband 's credit. When we found out that his credit had been pulled by XXXX XXXX we contacted UAMC immediately and they would do nothing to resolve the issue. My husband attempted to dispute the unauthorized credit pull by XXXX XXXX, but they would not remove the unauthorized credit pull from his credit report.

I am buying a new construction home with XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, FL ) - Per the contract we have to use their lender, Eagle Home Mortgage ( EHM ), in order to receive closing costs credit ( {$22000.00} ).
EHM is up charging the interest rate by over 1 % which ultimately causes the buyer to finance their own closing costs by paying them back to the lender who is also the builder. This has not just happened to me! We have at least 2 other verified cases of this with other people with stellar credit being changed 1 % to 1.5 % higher than market rate.
It is common practice for a buyer to take a higher interest rate to get a lender credit towards closing costs that they may be unable to cover BUT the contract clearly states that XXXX is covering {$22000.00} towards closing costs so WHY would a buyer need such a high interest rate if there is no lender credit?
If I am one of 3 in one NEW community that this has happened to how many people has this happened to that aren't even aware!

On XX/XX/XXXX My fianc and I went to via XXXXXXXX XXXX XXXXXXXX XXXX to purchase a property. Because my credit was stronger than his I was informed to put myself on the property and because there is no box to check for engaged, I was also suggested that I checked single. The only option were married, single or divorce. Nevertheless, XXXX and I continued the process toward getting the home.
On XX/XX/XXXX XXXX and I broke up. I went to the XXXX home site on XX/XX/XXXX to Notify XXXX of what had transpired and that I wanted to cancel. She said no problem! All I had to do was write a letter because she had a waiting list and someone else is interested in the property. I did as she asked and a letter was produced to her on XX/XX/XXXX, explaining the circumstances as to why I was cancelling the purchase of the home ( see attached ).
Nevertheless, the following week, XXXX informed me that my request was denied. I was surprised because she said the letter was sufficient! She said that XXXX will only allow me to transfer to another property. Moving forward I asked her to provide me with her boss information and after speaking with him ( XXXX XXXX ) it was evident that they were not letting me out and the only option in oorder to not lose my money, was to move forward with a transfer.
During or around the first week of XXXX. I came across XXXX XXXX property. On Friday XX/XX/XXXX I gave XXXX from XXXX XXXX dollars toward transferring from one property to the next. I went out of the country the following day XX/XX/XXXX and ever since then it has been rush, rush, rush. Everything was rushed and they/XXXX always threatened me that I would lose my deposits. They would say Send us more money or lose your deposit. Signed these papers or lose your deposit I clearly spoke to her about my travels plans but it was not respected. I sent XXXX ( 2 ) XXXX deposits one on XX/XX/XXXX and the other on XX/XX/XXXX. They sent me papers to sign that I didnt sign because I did not understand them. I returned on XX/XX/XXXX and I was asked to sign more papers that I dont understand. Nevertheless, on XX/XX/XXXX ( a week later ) I did an inspection with XXXX inspector ( XXXX ). He found 100+ issues with the property and my independent inspection found over 150 issues wrong the property. What upsets me is that XXXX still want to close at the end of the week which means that I will be getting a rushed job and most likely items will not be properly fixed with the issued found.
In addition to that, I have now discovered that my loan application has information on there that is not accurate. My income is incorrect and all of my debts are NOT included. I strongly believe and feel that XXXX is forcing me to go through with this deal and I dont think that I would truly qualify on my own despite my plea to them ... A lot of things were not done correctly and I think the loan process should stop and be further investigated by you guys. I think they are looking out for themselves and someone needs to look into this further.

Applying with XXXX XXXX to buy in XXXX XXXX, they referred to Eagle Home Mortgage. They are requiring that the loan must go thru Eagle Home Mortgage or you can not buy a home in their community. They will not sign the addendum allowing you to use your own lender. Neither Eagle Home Mortgage nor XXXX XXXX are paying any of the closing costs and are not providing any lender/builder credits on this transaction.

When shopping for a brand new home in XXXX XXXX, XXXX XXXX, Florida - all the Builders steer all mortgage loans to their own Lender and I have been using someone else. Unfortunately if I do not want to use their Lender I have to forfeit a {$7500.00} credit back to me towards about {$10000.00} worth of junk fee 's the Builder is charging me - just to make sure I use their Lender. I went to XXXX and XXXX, XXXX, XXXX, XXXX and all the builders there are doing it! I thought steering was illegal? I am being forced to use the Builders Lender no matter what Builder I choose - they are all doing it!
