29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a. Employees performing framing work are not protected from fall hazards by the use of a fall protection system. The employer fails to assure effective protections against falls as required by the standard, as demonstrated on June 8, 2022, when two employees installing roof sheathing on a residential roof with a 6:12 pitch, and two employees bracing roof trusses at 4 Zealand Place, Palm Coast, Florida, were exposed to a 10-ft 9-in and a 14 feet fall hazard to the ground, respectively, in that none of the employees were protected by a fall protection system. Paradise Builders of North Florida, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1375215, citation number 1, item number 1, and was affirmed as a final order on April 1, 2022, with respect to a workplace located at 147 College Street, Kingsland, GA 31548. Paradise Builders of North Florida, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1306360, citation number 2, item number 1, and was affirmed as a final order on May 23, 2018, with respect to a workplace located at 9874 Soldier Court Lot 60, Jacksonville, FL 32221.
