Description |
ORDERED that the petition for writ of certiorari is dismissed for failure to establish irreparable harm. See Williams v. Oken, 62 So. 3d 1129, 1132 (Fla. 2011); Bared & Co., Inc. v. McGuire, 670 So. 2d 153 (Fla. 4th DCA 1996). Certiorari review of a nonfinal order denying a motion to dismiss is extraordinarily limited. Citizens Prop. Ins. Corp. v. San Perdido Ass'n, Inc., 104 So. 3d 344, 352 (Fla. 2012). "[B]efore certiorari can be used to review non-final orders, the appellate court must focus on the threshold jurisdictional question: whether there is a material injury that cannot be corrected on appeal, otherwise termed as irreparable harm." Id. at 351. Here, Petitioner has an adequate remedy, if necessary, on appeal from a final order dismissing with prejudice. E.g., James Estate by James v. Martin Mem'l Hosp., 422 So. 2d 1043, 1045 (Fla. 4th DCA 1982); Busch v. Lennar Homes, LLC, 219 So. 3d 93, 95 (Fla. 5th DCA 2017); Williams v. City of Jacksonville, 191 So. 3d 925, 928 (Fla. 1st DCA 2016); Erwine v. Gamble, Pownal & Gilroy, Architects & Engineers, 343 So. 2d 859, 861 (Fla. 2d DCA 1976).
