29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. Employees performing residential framing work at elevations of six feet or more above the ground are not protected from fall hazards by a fall protection system. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on April 16, 2015, when employees were installing framing from on the roof structure of a one-story residence at 65 Morningstar Way (Lot. 164), Ponte Vedra, Florida 32081 without fall protections and were exposed to fall hazards of 10 and 14 feet above the concrete foundation and surrounding ground. Transformers Construction Services, Inc. previously committed a Willful violation of this standard with an 11(b) warning on October 1, 2014, when employees were installing framing from the first and second story of a residential house at 25 Molasses Court, Saint Johns, Florida 32259, which became a Final Order on March 9, 2015. (Inspection No. 997663) Transformers Construction Services, Inc. previously committed a Willful violation of this standard with an 11(b) warning on April 10, 2014, when employees were working on a residential house at 62 Stirlingshire Court, Saint Johns, Florida, 32259, which became a Final Order on August 6, 2014. (Inspection No. 967068) Transformers Construction Services, Inc. previously committed a Repeat violation of this standard on January 17, 2014, when employees were working on a residential house at 106 Cantley Way, Saint Augustine, Florida, 32259, which became a Final Order on April 2, 2014. 29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: a. On or about April 16, 2015, at the east and south side of the roof frame, employees operating Hitachi pneumatic nail guns to perform bracing work were not wearing eye protection, exposing them to being struck by flying debris or nails. Transformers Construction Services, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 967068, citation number 01, item number 001 and was affirmed as a final order on August 6, 2014, with respect to a workplace located at 62 Stirlingshire Court, Saint Johns, Florida, 32259. |
