Description |
ORD-Sua Sponte Dismissal ~ Appellant has not complied with this court's March 29, May 4, and May 29, 2018 orders to obtain a final, appealable order. The order granting summary judgment that appellant appealed is not final and appealable, because it merely says that summary judgment is "granted" and does not actually enter judgment for any party. Accordingly, it is sua sponte ORDERED that this appeal is DISMISSED without prejudice to appeal from a final, appealable order.GROSS, CONNER and KLINGENSMITH, JJ., concur.

Description |
Miscellaneous Order ~ ORDERED that appellant's May 20, 2018 "response to petition" does not comply with this court's March 29 and May 4, 2018 orders. The order granting summary judgment that appellant appealed is not final and appealable, because it merely says that summary judgment is "granted" and does not actually enter judgment for any party. In order for this appeal to proceed, appellant must obtain a final, appealable order from the trial court and file it with this court. Appellant is again ORDERED to do so within thirty (30) days, or this appeal will be dismissed without prejudice.
