ORDER GRANTING RELINQUISH JURISDICTION ~ Appellant's motion to relinquish jurisdiction and toll time for filing the initial brief is granted to the extent that jurisdiction is relinquished for 60 days for the trial court to rule on appellant's motion to vacate the final judgment under Florida Rule of Civil Procedure 1.540(b) for the reasons stated in the motion. Appellant shall file in this court a status report within 60 days of the present order or a notice of voluntary dismissal within 10 days of the entry of an order setting aside or vacating the final judgment of foreclosure, whichever is earlier. A party who is aggrieved by any order entered by the trial court must file a notice of appeal within 30 days of its rendition. See Fla. R. App. P. 9.110(b); 9.130(b). If the present appeal survives, the parties should consider moving for its consolidation with the new appeal. To the extent appellant requests judicial notice of a guardianship proceeding in the Tenth Judicial Circuit in and for Polk County, case number 2006CP-2317, the request for judicial notice is denied and appellant's appendix to the motion to relinquish, which includes a copy of the order from that proceeding, is stricken. In the event appellant places any pleadings from the guardianship proceeding in the trial court's record with respect to her rule 1.540(b) motion, those pleadings would be part of the record of any appeal from the trial court's order thereon.The time for serving the briefs shall be tolled during the relinquishment period and this court will direct appellant to serve the initial brief upon the conclusion of the relinquishment period.
