MISCELLANEOUS ORDER ~ The court notes that appellant filed a motion for extension of time to file a notice of appeal in the postconviction court. The postconviction court dismissed the motion without prejudice to file a petition for belated appeal, and appellant appealed the order of dismissal. The postconviction court erred in failing to treat appellant's motion for extension of time, filed within thirty days of the order denying postconviction relief, as a notice of appeal. To correct this error, this court treats this appeal as an appeal of the September 30, 2015, order denying appellant's rule 3.850 motion. Within 20 days, the circuit court clerk shall transmit the summary record in CRC88-10286CF to this court. Appellant is not obligated to file a brief. An optional brief, should appellant choose to file one, must be served within 60 days of the date of this order.
