ORD-SUA SPONTE ~ All My Sons Moving & Storage of Southwest Florida, Inc. (AMS) appeals the trial court's denial of a motion for relief from a "partial default final judgment" entered on count one of a three-count complaint. This appeal appears premature. No judgment, either by default or on the merits, has been entered on counts two and three, and these counts are interdependent with count one. See Fla. R. App. P. 9.110(k) ("A partial final judgment, other than one that disposes of an entire case as to any party, is one that disposes of a separate and distinct cause of action that is not interdependent with other pleaded claims."); see also Wagner v. Sticky Holsters, Inc., 291 So. 3d 1003, 1004 (Fla. 2d DCA 2020). We therefore relinquish jurisdiction to the trial court for thirty days for disposition of counts two and three. The clerk of the lower tribunal shall supplement the record within ten days of the entry of a judgment disposing of these remaining counts. No further order shall be needed for supplementation.Within thirty-five days of this order, AMS shall file a status report with this court. If the trial court fails to enter a final judgment on the remaining counts during the relinquishment period, AMS shall show cause why this appeal should not be dismissed for lack of jurisdiction.
