29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. At the sheet metal processing area located at 529 Codisco Way in Sanford FL, the Amada Queen PEGA-345 operator was exposed to continuous noise levels at 47.29 % of the allowable 8 hour TWA-Action Limit (85 dBA). The equivalent dBA level of 47.29 % is 84.6 dBA. The sampling was performed for 594 minutes during one shift on December 11, 2019. NOTE: The 8-hour TWA sound level of 85 dBA that triggers the requirement of a hearing conservation program (HCP) can be adjusted for work shifts less than or longer than 8 hours. When making the adjustment, the following formula is used: AL=90 + 16.1 x Log [50/{12.5(hours)]. Affected employee was exposed to continuous noise level over 594 minutes work shift. Therefore, the TWA sound level that triggers the requirement for a HCP was reduced to 82.1 dBA. |
