Appeal Dismissed by the Court (DA11) ~ The dismissal of the counterclaim with leave to amend is not final. At the same time, the complaint and the counterclaim are interdependent. They are interdependent because both the complaint and the counterclaim implicate whether or not the plaintiff unit owners legitimately own units in a manner that would permit them to vote in Association elections and to have standing to challenge the amendments to the Declaration.
