Miscellaneous Order ~ Appellant Pamela Morrison has filed a motion for appellate attorney's fees pursuant to section 9.1 of the parties' marital settlement agreement (MSA). The motion is remanded to the trial court because Appellant's entitlement to attorney's fees is contingent on her prevailing in her enforcement action. If Appellant ultimately establishes entitlement to attorney's fees pursuant to this provision of the MSA, the trial court is authorized to award her the reasonable attorney's fees incurred by her in this appeal. To the extent that Appellant's motion also seeks an award of appellate costs, the motion is stricken without prejudice to Appellant seeking such costs in the trial court. See Fla. R. App. P. 9.400(a).
