Description Order-Original Proceeding Dismissed ~ ORDERED that, having considered the response, reply, and sur-reply to this Court’s order to show cause, the petition for writ of certiorari is dismissed for lack of irreparable harm. See Williams v. Oken, 62 So. 3d 1129, 1132 (Fla. 2011); Bared & Co., Inc. v. McGuire, 670 So. 2d 153 (Fla. 4th DCA 1996) (explaining that a showing of material injury that cannot be adequately remedied on appeal is a prerequisite to an appellate court’s certiorari jurisdiction). Under the circumstances of this case, petitioners have failed to demonstrate that they will suffer material harm that cannot adequately be remedied on appeal. The trial court has bifurcated the punitive damages issue and has not allowed financial worth discovery - which has been recognized as supplying the irreparable harm for certiorari review of an order granting leave to plead punitive damages. Additionally, the case is being tried to a judge, not a jury, and we conclude there is no irreparable harm caused by the order merely allowing Respondent to plead the claim for punitive damages. Pursuant to the trial court’s order, Respondent will have to actually prove its entitlement to punitive damages by clear and convincing evidence at trial before the court will allow any financial worth discovery or proceed to a trial as to the amount of punitive damages. Under these unique facts, this Court lacks jurisdiction to review the order at issue. Further,ORDERED that petitioner’s August 6, 2021 motion for attorney’s fees is denied.GROSS, DAMOORGIAN and ARTAU, JJ., concur.

Description Order Denying Petition for Review ~ ORDERED that the petition for review is denied. The statutes providing for a public records exemption and restricting disclosure of information by regulators does not create an evidentiary privilege for Petitioner to oppose discovery in a judicial proceeding. Both statutes recognize that disclosure to a court may be appropriate. 15 U.S.C. § 18a(h) (“[N]o such information or documentary material may be made public, except as may be relevant to any administrative or judicial action or proceeding.”); § 542.28(9), Fla. Stat. (2018) (“However, the Attorney General or state attorney may disclose such investigative evidence to: (a) Any court or tribunal in this state . . . .”). Documents that Petitioner submitted to regulators do not automatically attain privileged status in judicial proceedings. Any privilege or confidentiality protections as to specific documents or information must come from an independent source. The trial court has not ruled on any privilege or protection claims as to any specific documents. The trial court did not depart from the essential requirements of law in declining to close the crime-fraud hearing. Denial is without prejudice for Petitioner to again request limited closure if documents are determined to be privilege or protected and if they must be discussed or disclosed during the hearing. Court proceedings are strongly presumed open, and any closure must comply with the requirements of Barron v.
