Miscellaneous Order ~ The wife’s motion for appellate attorney’s fees, and the supplemental motion for appellate attorney's fees, is remanded to the trial court. If the wife establishes her entitlement pursuant to section 61.16, Florida Statutes, the trial court is authorized to award her all or a portion of the reasonable appellate attorney’s fees. The merit of the respective positions of the parties in this appeal is not a factor that the trial court need consider. See Rados v. Rados, 791 So. 2d 1130 (Fla. 2d DCA 2001).In the motion for appellate attorney's fees and supplemental motion, the wife also included language suggesting she sought costs. The wife's request for costs is stricken without prejudice to the wife to file a timely motion with the lower tribunal. See Fla. R. App. P. 9.400(a).The husband's motion for appellate attorney’s fees is remanded to the trial court. If the husband establishes his entitlement pursuant to section 61.16, Florida Statutes, the trial court is authorized to award him all or a portion of the reasonable appellate attorney’s fees. Grant Clarification-77 ~ The appellee John D. Rich's motion for clarification is granted to the extent delineated herein. This case is being treated as an appeal of a final post decretal order. As such, within 10 days of the date of this order the appellant shall arrange with the clerk of the circuit court for preparation of the record required by Florida Rule of Appellate Procedure 9.110(e). In the alternative, the appellant may seek leave of this court for consolidation for record purposes of this appeal with another pending appeal or appeals in which the parties are engaged, to the extent that such consolidation may be feasible. The appellant should in that event arrange with the circuit clerk for transmission of only those portions of the record unique to this appeal.By its own motion the court strikes the appellant's initial brief. Once the formal record has been arranged for, as described above, the appellant shall serve an amended initial brief referencing the record on appeal. See Fla. R. App. P. 9.210(b)(3). dismiss appeal nonfinal/nonappealable order ~ Upon review of the appellant's response and the appellees' reply to this court's June 4, 2019, order on jurisdiction, the court concludes the Florida Rule of Appellate Procedure 9.110(k) mandates a dismissal of this appeal. The appeal is dismissed as from a nonappealable nonfinal order. This dismissal is without prejudice to the appellant to timely challenge an order or judgment that finalizes all claims and counterclaims in case 09 010023 FD-22, at which point the judgment of dissolution will be reviewable. See Fla. R. App. P. 9.110(h).The appellees' motion for clarification is denied as moot.The appellees' motion to strike is denied as moot.The appellant's motion for attorney's fees is denied.

Miscellaneous Order ~ The motion for clarification filed by the appellees (additional defendants) has raised a potential jurisdictional question in this appeal. Within 15 days of the date of this order, the appellants shall address the following issues. The appellees, either separately or jointly, may reply to the appellant's response within 15 days of its service. (1) Does the pendency of a third-party counterclaim affect the finality of the judgment on appeal, such that this court might not have jurisdiction over that judgment under rule 9.110(k)? See, e.g., Almacenes El Globo De Quito, S.A. v. Dalbeta L.C., 181 So. 3d 559, 562 (Fla. 3d DCA 2015). Even if the appellant argues primarily that rule 9.110(k) does not apply when third-party practice is involved (such that this court would have jurisdiction over the present appeal), the appellant should also address in the alternative whether, if the rule does apply, the issues on appeal and the issues to be resolved by the trial court as to the third-party counterclaim are so "interdependent," see id., that this court would have no jurisdiction. (2) Does severance under rule 1.270(b) in and of itself preclude the operation of rule 9.110(k), or does the interdependency analysis of rule 9.110(k) apply even when claims and counterclaims are formally severed by the trial court, as occurred in the present case? Appellee John D. Rich's motion for extension of time is denied without prejudice to request a briefing schedule after the court reviews the response and replies to the present order.

Miscellaneous Order ~ Within 15 days of the date of this order, the appellee shall clarify, replace, or withdraw its amended motion to dismiss as directed herein. It appears that there are two proceedings in the trial court, a dissolution action and a civil lawsuit. It is not necessarily clear from the factual and procedural recitations in the amended motion to dismiss which proceeding a given document was filed in.
