On or about March 16, 2021, at the northside of building No. 7, the employer did not ensure that two employees installing weather proofing material on a 4:12 pitch roof were protected from an 8-ft 4-in. fall hazard by the use of a fall protection system. The employees were wearing body harnesses but not tied off. b. On or about March 16, 2021, at the eastside of building No. 7, the employer did not ensure that one employee installing the drip edge on a 4:12 pitch roof was protected from an 8-ft 4-in. fall hazard by the use of a fall protection system. The employee was wearing a body harness but not tied-off. c. On or about March 16, 2021, at the southside of building No. 7, the employer did not ensure that three employees performing roofing work on a 4:12 pitch roof had their personal fall arrest system setup correctly, in that their rope-grab and lanyards were setup close to the end of the lifeline, exposing to an 8-ft-4-inches fall hazard. James Shelton Roofing, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1216281, citation number 2, item number 1, and was affirmed as a final order on June 16, 2017, with respect to a workplace located at 8300 Osceola Polk Line Rd., Davenport, FL 33896. |

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section: a. Employees performing residential framing work at elevations of six feet or more above the ground are not protected from fall hazards by a fall protection system. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on December 12, 2014, when employees were performing a re-roofing on the 4:12 pitch roof of a single-story residential house at 4264 Queensway Drive, Jacksonville, Florida 32257 without fall protection and were exposed to fall hazards of eight and thirteen feet above the ground. James Shelton Roofing, LLC. previously committed a Serious violation of this standard on September 4, 2013, when employees were working on a residential house at 6604 and 6614 Merrill Road, Jacksonville, Florida, 32277, which became a Final Order on October 5, 2013. (Inspection No. 938007) James Shelton Roofing, LLC. previously committed a Serious violation of this standard on July 29, 2013, when employees were working on a residential house at 11759 Lake Ride Drive, Jacksonville, Florida, 32223, which became a Final Order on September 20, 2013. (Inspection No. 923787) To abate this violation, the employer must ensure that all employees wear appropriate fall protection or install a guardrail or safety net system when an employee works above 6 feet off the surface. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including and explanation of how these steps protect its employees from fall hazards. |
