Appellant, by way of a timely notice of appeal filed by counsel, Jason Lewis, sought review of his judgment and sentence imposed on May 17, 2022, after a revocation of his probation. On November 14, 2022, this Court issued an order directing Appellant to either serve an initial brief or show cause why the appeal should not be dismissed for failure to serve an initial brief. No response was filed. On January 23, 2023, this Court issued a second order directing Appellant to either file the initial brief or show cause why the appeal should not be dismissed for failure to comply with the Court's November 14, 2022, order. No response was filed. On March 7, 2023, this Court dismissed the case for Appellant's failure to respond to the orders dated November 14, 2022, and January 23, 2023. Mr. Lewis filed a response docketed March 9, 2023, in which he asks this Court to reinstate the appeal.
The Court treats the response docketed on March 9, 2023, as a motion for reinstatement and grants the motion. The appeal is reinstated. Within ten days, counsel for Appellant shall ensure the filing of the Designation of the Second Circuit Public Defender's Office.
Attorney Jason Lewis failed to respond to the orders of this Court and his disregard for the rules and orders of this Court led to the dismissal of Appellant's appeal. Accordingly, the Court warns Mr. Lewis that further failure to comply with the orders of this Court will result in sanctions including an oral reprimand and/or referral to The Florida Bar.
Finally, the Court discharges the orders to show cause dated November 14, 2022, and January 23, 2023.
