Wells Fargo Bank, 258 So. 3d 539 (Fla. 3d DCA 2018) ("we agree with the Second District that the subject order, merely scheduling a foreclosure sale pursuant to a valid final foreclosure judgment, 'is a purely administrative, interlocutory step in the judicial sales process,' and therefore, is neither an appealable final order under Florida Rule of Appellate Procedure 9.110, nor an appealable, non-final order under rule 9.130.").

Type Order
Subtype Order to File Response re Jurisdiction
Description ORDERED that, within ten (10) days from the date of this order, Appellant shall file in this court a brief statement explaining the basis for this court's subject matter jurisdiction over the order appealed in this case, citing supporting legal authorities. Appellant shall specifically addresshow the appeal is timely filed as to the June 7, 2024 final judgment of foreclosure, as the trial court docket does not reflect that any motions tolled rendition of the final judgment. See Fla. R. App. P. 9.110; see also Epicor Software Corp. v. Coopers & Clarke, Inc., 928 So. 2d 1249, 1251 (Fla. 3d DCA 2006) (noting that "jurisdictional time limits such as the time for filing a notice of appeal or a motion for a new trial, may not be extended for any reason") (quoting Bank One, N.A. v. Batronie, 884 So. 2d 346, 349 (Fla. 2d DCA 2004)). Further, address how the October 1, 2024 order resetting foreclosure sale is a final or nonfinal appealable order, as it merely reschedules a foreclosure sale. See Venezia v. Wells Fargo Bank, 258 So. 3d 539 (Fla. 3d DCA 2018) ("we agree with the Second District that the subject order, merely scheduling a foreclosure sale pursuant to a valid final foreclosure judgment, 'is a purely administrative, interlocutory step in the judicial sales process,' and therefore, is neither an appealable final order under Florida Rule of Appellate Procedure 9.110, nor an appealable, non-final order under rule 9.130."); Pridgen v. First Union Bank, 879 So. 2d 21 (Fla. 2d DCA 2004) ("An order that merely schedules a foreclosure sale is not a final appealable order."); further, Appellee may file a response within ten (10) days of service of that statement.
