Description ORD-Sua Sponte ~ Upon consideration of appellant’s June 28, 2019 jurisdictional statement and appellees’ July 9, 2019 response, it is ORDERED sua sponte that the above-styled appeal shall proceed as a final appeal as to the “partial final judgment on count 7 of third amended complaint” pursuant to Florida Rule of Appellate Procedure 9.170. Fla. R. App. P. 9.170(b) (“Except for proceedings under rule 9.100 and rule 9.130(a), appeals of orders rendered in probate and guardianship cases shall be limited to orders that finally determine a right or obligation of an interested person as defined in the Florida Probate Code.”); In re Estate of Bierman, 587 So. 2d 1163, 1166 (Fla. 4th DCA 1991) ("However, where the rights of the parties as relates to their interest in the estate are not finally determined, then the orders are not deemed final for purposes of appeal.”). Further,ORDERED that the appeal pending in 4D19-2052 is dismissed as duplicative. Fla. R. App. P. 9.110(l) (“Except as provided in rule 9.020(h), if a notice of appeal is filed before rendition of a final order, the appeal shall be subject to dismissal as premature. However, the lower tribunal retains jurisdiction to render a final order, and if a final order is rendered before dismissal of the premature appeal, the premature notice of appeal shall be considered effective to vest jurisdiction in the court to review the final order.”). Further,ORDERED that appellant’s request for consolidation, found in the June 28, 2019 jurisdictional statement, is denied as moot.
