29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a. On or about May 15, 2013, at the preparation room, employees were potentially exposed to flammable and corrosive chemicals such as, but not limited to, Dry Hair Cleaner, Cavicel, Hy-Vis, Nature-Glo, Jaundibalm, DMQ Damp Mop Neutral Disinfectant Cleaner, and Embalming Aerosol Spray which were capable of causing severe irritation and/or burns to the eye and skin. The employer had not developed nor implemented a written hazard communication program. |

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a. On or about May 15, 2013, at the preparation room, employees were potentially exposed to flammable and corrosive chemicals such as, but not limited to, Dry Hair Cleaner, Cavicel, Hy-vis, Nature-glo, Jaundibalm, DMQ Damp Mop Neutral Disinfectant Cleaner, and Embalming Aerosol Spray. These chemicals were capable of causing sever irritation and/or burns to the eye and skin and the employer had not trained the employees on the health and physical hazards of these chemicals at initial of employment. |

On or about May 15, 2013, an employee was exposed to formaldehyde at a Time Weighted Average (TWA) of 0.28 parts per millions (PPM), below the limit of 0.75 PPM, while embalming. The sampling was performed for 175 minutes during one shift on August 26, 2013. The employer did not conducted an initial monitoring to determine employees exposure to formaldehyde. |
