On or about May 22, 2012, the employer was using polyvinyl chloride (PVC) pipe to transport air with a pressure of 110 pounds per square inch (psi) to operate equipment thoughout the fabrication shop. The PVC piping was not approved for use with compressed air, and could fail or rupture, exposing employees to laceration and punctured hazards.

Citation text line 29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable: a. On or about May 22, 2012, an employee was required to wear a N95 dust respirator when wet cutting natural granite slabs and the employer did not establish and implement a written respiratory protection program that addressed the worksite-specific procedures such as but not limited to employee medical evaluations, fit testing, and training on the use, maintenance and care of the respirators.
