See Irvine v. T. Southwood 1295, Inc., 948 So. 2d 981, 983 (Fla. 1st DCA 2007) (dismissing appeal from a judgment on a counterclaim as premature because the complaint remained pending in the trial court). Further, the court lacks jurisdiction to review the order as it relates to MECNB, Inc. as either a petition for writ of certiorari or as a nonfinal appeal. Fla. R. App. P. 9.100(c)(1), 9.130(b); Doukas v. Doukas, 335 So. 3d 218, 219 (Fla. 1st DCA 2022) (“A motion for rehearing is not authorized as to a non-final order, so it does not toll the time for appeal.”); Arce v. Maher Guiley & Maher, P.A., 936 So. 2d 682 (Fla. 5th DCA 2006) (explaining a motion for rehearing does not suspend the time for filing a petition for writ of certiorari). This appeal shall proceed solely as to appellant Robert Rodriguez.KLINGENSMITH, C.J., WARNER and CONNER, JJ., concur.
