After calling my mortgage servicer Fairway to confirm ahead of time I could overpay early my first mortgage payment with no issues I paid {$4500.00} on XX/XX/XXXX. As of XX/XX/XXXX this payment is not reflected, and as of XX/XX/XXXX I have not been able to get an explanation for this after contacting the company.
I have documentation from the company indicating payment was made, and my bank account was debited on XX/XX/XXXX for this amount. I am trying to get an explanation from the company, but they have not been forthcoming with why my payment has not been applied to principle or interest and shows as my first payment still due. I fear they are trying to take more money from me outright without crediting me this first oaymeny, and even if they find the money they would charge me excess interest on top of this and avoid applying my payment to principal/interest early. I paid on XX/XX/XXXX and I expect my credit to principle and interest to reflect my payment, as I prepaid my XX/XX/XXXX first payment.
I called twice but was unable to resolve this, and the service provider seems reluctant to put anything in writing so far.
Please help me get them to reflect my payment. Happy to provide my documentation.

On XX/XX/2021 I began to research housing assistance programs offered by the State of Florida. Their website, XXXX listed XXXX XXXX as a loan officer working for Fairway Independent Mortgage Corporation as a XXXX XXXX XXXX Member with a " Silver Tier '' rating. That same day I attempted to contact XXXX in regards to getting prequalified for a VA home loan. I reached her voicemail and left a message requesting a callback. After not hearing back from XXXX for a few days I attempted to contact her again on XX/XX/2021. Again unable to reach her I left a message requesting her to contact me. As of today, XX/XX/2021, I have never received a response from XXXX.
On XX/XX/2021, I submitted a loan application using Fairway Independent Mortgage Corporation 's website. Later that day XXXX XXXX contacted me regarding my application. I expressed my interest in utilizing a Florida homebuyer assistance program titled 'Salute our Soldiers PLUS '. XXXX informed me that she would include that information in my application but as she was not a loan officer, I would need to wait to speak with an officer for more information on that program. XXXX requested additional information and financial documents from me before she was able to schedule a call between me and a loan officer, XXXX. This call was scheduled for XX/XX/2021.
On XX/XX/2021, the loan officer, XXXX, contacted me on my cell phone. After answering his questions regarding my loan application I again inquired about the XXXX XXXX XXXX XXXX program. XXXX stated that he was not familiar with that particular program. He also mentioned how VA loans and homebuyer assistance programs are not always compatible with each other. I requested that he take the time to research this program further as the information I was able to obtain from the XXXX website was limited. XXXX agreed to looking further into it and would call me back when he had an answer.
Approximately XXXX XXXX after that call ended XXXX calls me back. He advises me that he was unable to determine if the housing assistance program and VA loans could be used together. His recommendation is that I should contact other lenders and that XXXX would not be moving forward with my application. While speaking with him I acknowledged that him being based in California has limitations on how much he knows about Florida specific programs. XXXX mentions that his " Vice President '' is licensed in Florida but would not be able to assist me either. I question him about the local branch that is listed on XXXX 's website as being in the same city I currently reside, XXXX, FL. XXXX says I should contact that agent. I respond that I have attempted to contact XXXX multiple times but never received a response. XXXX and I agree that XXXX is not the best choice for my mortgage needs and that we should end the business relationship. I inquire about what will happen to the financial documents that I have submitted. He was unable to answer but said he would contact his compliance department to find out more and contact me back.
Approximately XXXX XXXX later XXXX calls me. He begins the conversation by apologizing for being so 'direct ' in the previous call. And then he begins to backpedal on his recommendation that I seek out other lenders. XXXX mentions he can get me in contact with a loan officer based on the east coast that would have a better understanding of Florida specific programs. I respond that my confidence that XXXX is able to meet my needs has wained and that I no longer wish to continue with the application process. I request that my loan application be withdrawn.

Been trying to work with XXXX since XX/XX/20 to start a loan process. Several emails and phone calls have been made to him to start the process of a possible $ XXXX {$75.00} mortgage we discussed back in the beginning of XXXX. He needs " documentation '' and was to send a list of what he needed last month. I have yet to get this and have left two voice mails and several cyber messages and a text. I have yet to get a response. It has been three months. The house I rent is willing to sell and keeps asking. I even have DPA ALREADY approved.

At this time, this formal complaint in in regards to the Fairway Independent Mortgage Agents, and in regards to the overall application process as an " Applicant '' and Consumer. I have first decided to opt out of credit authorization as referenced in the email attachment. This overall Claim and according to the FCRA and 15 US code 1602 ( f ), explaining that CREDIT IS MY RIGHT ( ECOA ). Not only that but pursuant to 15 US Code 1681q and 15 US Code 6821 related to the obtaining personal and private information from a consumer reporting agency under false pretenses ; Which would be aggravated identity theft pursuant to 18 US Code 1028A. FAIRWAY agents have deliberately violated the disclosures and regulations of " the Applicant is not required to provided certain information, the statute makes it unlawful for any creditor to discriminate against any applicant with respect to any aspect of a credit transaction, ( Credit Agreement in this case ), and 3 ) because the applicant has in good faith exercised any right under the Consumer Credit Protection Act.. I am Competent and have an Affidavit of Beneficial ownership to support. Secondly, after providing my principal information and submitting my application, I have then referenced to the following Agent asking, who will be securing my rights to the application and the proceeds due on the application pursuant to the Truth in Lending Act Regulation Z as it relates to how an overall Credit Agreement and Consumer with respects to choosing how they want to enter into an Agreement.I the consumer have a right to acquire the Agricultural Goods for my household and family ( Federal Register/Vol. 86, No. 227 ). I also have the right to enter a transaction without Fraudulent and Deceptive practices ( 15 US Code sec 45d ) ( pursuant to 15 U.S. Code 1691 ( A ) ( B ), '' b ) The term Applicant means any person who applies to a creditor directly for an extension, renewal, or continuation of credit, or applies to a creditor indirectly by use of an existing credit plan for an amount exceeding a previously established credit limit. ( ECOA Regulation B ) '' As referenced in 15 US Code sec, 45D ; I have requested the proceeds due upon the application where credits are being requested TRUTH AND LENDING ACT ( REG Z ). I am transferring principal interest upon Security ( application ). Lastly, providing incomes as a consumer is unrelated due the According to The Gold Standard ( HRJ 192 ), one can not demand any certain form of currency that would like to receive if it is dollar for dollar. I have attached supplemental documents supporting my claim and performance enforcing the obligation due upon acceptance of my security instrument, ( Application ) and the proceeds now due.
XXXX HAS ALSO FURNISHED UNDER FALSE PRETENSES MY PRIVATE AND PERSONAL INFORMATION ( Not only that but pursuant to 15 US Code 1681q and 15 US Code 6821 related to the obtaining personal and private information from a consumer reporting agency under false pretenses ) .31 U.S. Code 5118 " ( a ) In this section ( 1 ) gold clause means a provision in or related to an obligation alleging to give the obligee a right to require payment in ( A ) gold ; ( B ) a particular United States coin or currency ; or ( C ) United States money measured in gold or a particular United States coin or currency.
( 2 ) public debt obligation means a domestic obligation issued or guaranteed by the United States Government to repay money or interest. ''
