End of XX/XX/XXXX Consumer Portfolio Services who are registered in Nevada, but operate out of California extended me an auto loan through a car dealership in Florida. I signed loan paperwork on XX/XX/XXXX and drove off with my vehicle thinking I had secured basic transportation for my family and I.
A few days after I sign paperwork that says I have a car loan the dealership calls and says the bank wants more information. They need canceled check from my direct deposit. I send them what I was forwarded by the accounting department of the company. Another week or so passes by and the dealership calls and says the bank still isn't satisfied, they want bank statements.
I sent those and a week or so later the dealership calls and says the bank isn't going to finance the loan at all because I took to long and they think I'm a fraud, which is very ironic.
So many violations have been made throughout this buying process. I will point out the Trustee from Consumer Portfolio Services signed off on a report just two months ago saying they would not break laws. I have paperwork that says I have a loan and them backing out is fraudulent. Requesting all the extra personal information after signing paperwork is a violation of the Privacy Act of 1974. 16CFR 433.2 states preservation of Consumer claims. 17CFR424 states that they will not commit language fraud. They are also operating out of a state other than the one they incorporated in. 16CFR 444.1 states that my signature is the security for my car loan. There should not be any reason for them to take me through so much when I am already going through it in life.
I lost love ones to XXXX XXXX during this whole process and have been stressed to the max with the shady tactics of Consumer Portfolio. Services. This has caused mental stress and anguish. I do not want another Consumer to go through this during the buying process.
Purchasing a car should be a simple process, but these fraudulent law breaking techniques make it a nightmare for so many including myself.

Formal Dispute of Improper Use of Credit Report and Violations of the Fair Credit Reporting Act I am writing to formally report a series of serious issues concerning the improper use of my credit report and violations of my rights under the Fair Credit Reporting Act ( FCRA ). While I was deployed on XX/XX/XXXX ( XX/XX/XXXX ) to XX/XX/XXXX ( XX/XX/XXXX ) and from XX/XX/XXXX ( XX/XX/XXXX ) to XX/XX/XXXX ( XX/XX/XXXX ) as an active member of the military I have encountered significant problems with my credit report that include allegations of racial profiling, a defective vehicle issue, and unauthorized reporting.
1. Violations of the Fair Credit Reporting Act a. Privacy Rights Violations Under 15 U.S.C. 1681, I have the right to privacy concerning my credit information. My credit report has been accessed and utilized without my consent, which is a violation of my privacy rights. This includes unauthorized access by [ CONSUMER PORTFOLIO SVC/CAR DEALER ] and the reporting of inaccurate information while I was on military deployment b. Permissible Purpose and Instructions According to 15 U.S.C. 1681b and 15 U.S.C. 1681c, consumer reporting agencies and creditors must have a permissible purpose to access my credit report and must act according to my instructions regarding reporting. I did not authorize [ CONSUMER PORTFOLIO SVC/CAR DEALER ] to report any information regarding my accounts while I was on military deployment nor did I provide instructions for such reporting.
c. Incorrect Reporting of Payments Per 15 U.S.C. 1681s-2, creditors are prohibited from inaccurately reporting late payments after advising consumer to put accounts on hold or pick the car due to military deployment and Despite my timely payments since I returned from deployment [ CONSUMER PORTFOLIO SVC/CAR DEALER ] has reported these payments as late. This misrepresentation is a clear violation of this provision.
2. Defective Vehicle Issue I purchased a vehicle from [ CONSUMER PORTFOLIO SVC/CAR DEALER ] that was defective ( specifically with rotor damage that prevented it from passing a state inspection ). I reported this issue to [ CONSUMER PORTFOLIO SVC/ CAR DEALER ] and requested either a pickup of the defective vehicle or to place my account on hold until my return from deployment. My request was denied, and [ CONSUMER PORTFOLIO SVC/CAR DEALER ] failed to address the issue adequately but rather resolved in aggressive and malicious attacks of my character and reputation. Consequently, the creditor reported my payments as late, exacerbating the situation.
3. Allegations of Racial Profiling The handling of my credit information and the negative reporting may be influenced by racial profiling. This unfair treatment has resulted in discriminatory practices, which are in violation of the Equal Credit Opportunity Act ( ECOA ) and other relevant anti-discrimination laws.
4. Identity Theft and Fraud The misuse of my credit report and the reporting of unauthorized and inaccurate information raise concerns of aggravated identity theft under 18 U.S.C. 1028. This mishandling has caused substantial harm to my financial standing and personal well-being and as well as compromising my security and safety also I have not beable to get decent apartment to settle down to mentally recalibrate myself in other to perform my duties effectively as an active military since my return from deployment 5. Damages and Impact The improper reporting has caused defamation of my character, emotional distress, and XXXX, enxiety as well as compromised my safety as an active military in the public. The inaccuracies and unauthorized disclosures have significantly impacted my financial and personal life.
6. Requested Actions Given these serious violations, I request that the CFPB : Investigate the improper use of my credit report and the alleged violations of the FCRA and other federal laws.
Assist in correcting the inaccuracies reported by XXXX, XXXX, and XXXX.
Facilitate compensation for the damages incurred, including emotional distress and reputational harm.
Ensure that the allegations of racial profiling and unauthorized access are thoroughly examined and addressed.

From being falsely advertised and finance manager waiting until my credit was run to tell me the price I disclosed and agreed upon mutually, was no longer on the table to multiple problems with a allegedly maintained maintenance vehicle. The problems and inconsistencies from this dealership has been a nightmare! I purchased a vehicle at XXXX XXXX of XXXX of 2024 and was told I will not be able to leave without purchasing warranty. I made it abundantly clear I will cancel warranty after XXXX XXXX because that what I was coerce to do. Within the first XXXX XXXX the vehicle stopped with me and a series of problems XXXX up such as water dispensers were not working correctly within the same day of getting the vehicle. As the company ; XXXX XXXX confirmed prior to signing contract that vehicle was throughly maintenance and checks were completed. XX/XX/year> I went in person with filled document needed to cancel warranty. I was disclosed by the finance manager the process takes up to XXXXXXXX XXXX via text message. The total amount of warranty is {$2800.00}. Although I knew that was very long for a warranty to processed I waited XXXX XXXX and followed up for an update and was ignored. As per to the conversation had with the warranty company ; theyve confirmed it was not cancelled and information to initiate cancellation was not submitted until XXXX. The total refund was XXXX and finance manager confirmed the service department charged me for discrepancies and malfunctions that was not properly corrected prior to vehicle being in my possession.
Refund from Dealership to my loan finance company consumer portfolio was not correct and the reasoning is not valid and or correct at all. I need this to be investigated please, this is affecting my credit and this inaccuracy will be reflected on my credit.

I was a co-signer for an elderly individual-Applied for an auto loan through XXXX XXXX, the loan was transferred from XXXX financing company to another, without our approval. After the smoke had cleared we found out a second third party company XXXX as Consumer Portfolio Services had financed the loan. the initial loan was for {$10000.00} plus to finance the vehicle in early XX/XX/XXXX-The vehicle was paid up according to our records, however, XXXX stated there were additional interests in excess of {$5000.00}? What loan sharks!!! Our monthly payments were {$280.00}, however, only $ XXXX {$100.00} monthly were actually applied to the actual loan. When inquired about it, the company reps stated it was normal procedure. In reviewing our monthly payments, we discovered XXXX would intentionally post our payments late in order to justify charging additional interests and fees. When we paid by money order they would state they did not receive the payment until a week later, yeah right. When we made payments online we were forced to pay additional fees through XXXX XXXX, and the payments were still posted late. We challenged this and got nowhere with this company. There is additional info which I will upload, however, in short we were ripped off by this company and XXXX Automotives whom we thought we were dealing with initially. There were constant mechanical issues with the car, we called several times to complain about it, we were told our problem now. In addition to paying off the truck, we lost a lot of money in repairs, new tires, motor issues, etc ... The last payment made to XXXX was in XX/XX/XXXX for $ XXXX course they did not apply that amount to our account. In early XX/XX/XXXX XXXX finally picked up the vehicle, sold it, and stated, we XXXX or XXXX not receive a refund based on the amount received at the auction. In XX/XX/XXXX, a payment of {$1500.00} was posted to our account, shortly thereafter, XXXX contacted us to tell us they sold the car and we still owe them in excess of {$5000.00}? Really? We have no idea what XXXX actually received for the vehicle, they would not release that information in writing. Okay, so never mind the fact that we had already paid for the vehicle ( excluding their outrageous claims of excess interests charges & fees ) in addition to all of the money that we spent in mechanic fees/repairs. They did not care. These people have been constantly calling and harrassing us and have reported these fraudulent charges to credit agencies, this makes us furious. in XX/XX/XXXX The FTC fined XXXX XXXX https : XXXX ) It does n't look like anything has changed. I purchase a vehicle from XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, XXXXMy Salesperson was XXXX XXXX. The financial person didthe additional fees to make payment each month on my loanwith Consumer Portfolio Services, INC ( CPS ) locatedXXXX XXXX XXXX, XXXX, XXXX XXXX XXXX went to make my XXXX payment the customer servicerepresentative that you have to {$12.00} for each paymentI informed her that no one told us that. On the statementthat was mail to us, it does n't say nothing about any feesI told her that was wrong for your company not to informedthe customers of this fee before signing the loan or on the statement. I had to transfer additional funds in the amount for this. If you pay online itsa {$12.00} or over the phone. She informed that it 's not on thestatements, only when you call to make your payment we letyou know about the fees. I called the XXXX XXXX, themanager at XXXX to let them know this is not rightthat CPS have hidden fees with my loans. I told him thatI told XXXX XXXX my budget, due this additional fee I wentover my budget to make payment on my car. I was mad Ithink this is a way to get over customers. On XXXX XXXX, XXXXXXXX. XXXX called CPS to asked them if something can be done, customer servicerepresentative said no, this the way CPS let customerknow about any fees. The dealership was not aware of theseany additional fees. I told the customer service Rep thatother companies have the fees on the statement why CPSdo n't do that, she said this is the why we do things. I told herI told I left over XXXX messages for a manager to call meregarding this matter, NO ONLY never called me back.

The account for the vehicle purchased is with Consumer Portfolio Services.
The balance allegedly owed is {$12000.00}.
I do not recall where or who the original loan agent is.
When I purchased the vehicle, it had several mechanical issues. So many so, that I was not able to repair them.
I contacted the dealership to advise they sold me a car that I can not use nor fix. Needless to say I did get a very professional response. The car was voluntarily returned a few days later by way of tow truck, which they provided.
I was not even offered another vehicle. I lost my down payment and the car they sold me and new it was damaged.
I asked if they would be any monies owed, and because they received there vehicle back, nothing was going to billed to me.
Did I receive paperwork, no. Did I receive paperwork that the vehicle was returned, no.
I will not pay for a vehicle that was inoperable and that was returned back, which they probably fixed and resold.
I am asking, please get this deb off my report as it is there unfairly.
Had I done damage to the car or caused anything to where it became inoperable, I would own up to my responsibility. As should the dealership for selling a lemon.

In XX/XX/XXXX, I had a car on loan with Consumer Portfolio Services. After medical and subsequently financial reasons, I could no longer keep the car. In late XX/XX/XXXX, after continued harrassment and threatening calls from CPS to me, my parents and friends, I agreed to give up the car. I was paying CPS {$450.00} per month, which exceed the value of the car and loan amount. There were times when I was late, but was always able to catch up. CPS sold the car for approximately {$5400.00} ( which would indicate the mint condition of the car ). CPS starting contacting me, my parents and friends again stating that I now owed them {$8000.00} more. I finally ended up changing my telephone number, but my parents are still called with scare tactics as if they are personal friends of mine and something has happened. My mother has called several times worried until I was able to calm her down. I recently pulled my credit report and discovered that CPS is falsely showing that I was paying them {$47.00} per month in order to keep the account open. I am not able to purchase another car as my credit report reflects that CPS are still holding the account open four years after selling the car. I pray that something can be done regarding this matter. I appreciate your consideration.

Yet another complaint against Consumer Portfolio Services. This will be my XXXX and Hopefully final complaint against them. They have replied to an earlier complaint, I have disputed it and have had no response. so here it is. The contract should be NULL and Void as the Main applicant ( XXXX XXXX ) NEVER signed the contract.
The contract should be deemed null and void.

On the contract you can see that the due date is to be the XXXX of each month. When the XXXX payment was made early, ( on the first of the month to be considered for the up-coming payment on the XXXX ). Cps took it upon themselves to change the due date to the XXXX of the month, in the situation, it showed that a payment had been made for the XXXX of the previous month and then due again 2 days later on the XXXX ( which is when the account started showing a delinquency ). XXXX XXXX noticed the account was showing behind, when in fact it was paid ahead. He contacted CPS via phone and was told they had permission to change the due date, he said that neither he nor XXXX XXXX authorized this change, they dismissed it and refused to put the date back to the XXXX. He then asked for a written and signed document from either him or XXXX XXXX, requesting proof of the change, it has been over 4 years and still no such document!!!

XXXX XXXX was NOT present at the time of purchase and did NOT sign the contract for the loan. Her son was employed by the selling dealership and was allowed by the selling dealership to purchase and sign the contract for XXXX XXXX, even though she may have given verbal permission over the phone for him to do so, there was NO power of attorney signed. A hand writing analysis can be performed to verify the signature is Not XXXX signature. In fact she was at her place of employment ( working ) XXXX miles away from the selling dealership. ( this can be proved from payroll records. ) 3.
The vehicle was purchased for a 3rd party, which to the best of my knowledge is NOT allowed by CPS. In fact neither XXXX XXXX nor XXXX XXXX ever driven the vehicle ( the vehicle in question is a manual shift, neither one of them know how to drive a manual transmission. ) The contract itself is not even a CPS contract. Cps has been trying to implement policies and fees off of someone else 's contract. The contract is on an XXXX contract, and only has CPS ( hand written ) on it, with NO address or phone contact information for CPS.
For any one or all of the above reasons, the contract should be considered NULL and VOID, and the vehicle returned to CPS, with all and any Balances removed, and the loan as a whole be removed from XXXX XXXX and XXXX XXXX credit reports considering she NEVER signed the contract in the first place.
We have copies of the contract and XXXX XXXX Signature that can be provided, we can also go to a notary public to verify her signature if needed.
