Complaint What Happened On XX/XX/year> my loan was to be transferred from XXXX XXXX XXXX XXXX XXXX officially. Ive had my loan for XXXX years. I have an XXXX XXXX XXXX never missed XXXX payment on this been late or on any other account I have I have exceptional payment history When the loan was transferred I had an escrow balance of $ XXXX.on XX/XX/XXXX I received a bill from slide insurance company for a new premium on my policy because farmers insurance company was pulling out of Florida and XXXX had contacted slide for me on XX/XX/XXXX. I contacted slide and told them I did not want to that policy that I wanted it canceled it would not be paid and they did they did that they issued me a statement saying it was canceled on XXXX and they would be refunding me my money, but I had to ask for the refund which I did. I did in return called XXXX and XXXXXXXX XXXX. I talked to XXXX in the insurance department with XXXX and told her that I had canceled the insurance and I did not need that paid out of my escrow. She told me not to worry about it because my insurance will not not due till XXXX XXXX, and my loan wasnt transferring until XX/XX/XXXX and that she would let the other insurance casino and I said well Ill call them as well so I called XXXXXXXX XXXX because they told me they couldnt give me any information about my account or talk to me about my account because I had not received the account they transfer yet and that would not be affected till XX/XX/XXXX so they assured me that everything would be fine then on the XX/XX/XXXX XXXX XXXX who said they didnt have my account yet paid a insurance company that I told them and XXXX not to pay that I had canceled and in return of that since they did that my escrow has been screwed up. They said they had to advanced me this much advanced me that much and then when I finally got the refund back from the insurance company they paid mistakenly. They took half of it out for the advances. They gave me so now XXXX in the negative all because they hate something they were supposed to pay and didnt even supposed to have my account then so and Ive XXXX to work it out with him since XXXX and I cant get anywhere with them. Theyre not listening to me and now Im in the negative and they want their money and I dont have it and Im always gon na be in the negative because Im never gon na be able to get out of it and they wont listen to me and Ive have exceptional credit and exceptional payment history on everything I have and they were gon na XXXX me up. Theyre the worst Mortgage Ive ever seen in the worst customer service to deal with. They screwed up my insurance trying to tell me I had to have two policies on my insurance because I live in a condo I mean theyre XXXX up. I had a fight with him over that. I mean this has been the worst experience since XXXX Ive had since Ive had my loan and Ive had XXXX years. I need help fixing this because XXXX not getting anywhere with these people and if they XXXX me up in my good credit, XXXX highly disenchanted with the whole system

Complaint What Happened My home is located in XXXX XXXX FL and it is an HOA. I have always had flood insurance and home insurance on my home. The flood insurance isthrough my HOA ( XXXX XXXX ). In XXXX of XXXX, Valon Mortgage purchased the loan servicing of my mortgage from XXXX XXXX. XXXX XXXX went out of business. Before New Rez went out of business and got purchased by Valon, I sent in certificate of flood and homeowner insurance coverage to prove that I have always had flood insurance on my home for the 6 years I have lived here. XXXX XXXX never responded or provided a refund. In XX/XX/XXXX, Valon became my new mortgage servicer. In XX/XX/XXXX, a Valon escrow department service rep gave me an email and suggested I send my proof of insurance to XXXX. I emailed everything in as directed and explained that XXXX XXXX owed me an escrow check and since Valon acquired XXXX XXXX, this was now their responsibility. In XX/XX/XXXX, I called Valon again and customer service representiative said said I need to email my proof to XXXX. I followed back up on XX/XX/XXXX & XX/XX/XXXX and got no response. It was a XXXX box email that never had a response. On XX/XX/XXXX, I called Valon mortgage again and spoke with XXXX in the XXXX Department. I was very frustrated and ready to call an attorney because Valon owed me thousands of dollars. She asked me to send my proof of insurance to XXXX and explained to me that Valon had the responsibility to refund my escrow and that it would be a lengthy process but I would eventually get my money back. It is now XX/XX/XXXX and I still have no refund. Although their customer service team has been doing what they can to help me, Valon and XXXX XXXX have had over {$10000.00} of my money over a year. This is egregious and illegal I desperately need assistance and I also live in an area that has been affected by XXXX hurricanes and am a disaster and desperately need my money back. If I dont get any assistance, I am prepared to call the your agency and begin a litigation process.

Complaint What Happened XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, Florida [ Date : XX/XX/XXXX ] To : Consumer Financial Protection Bureau ( CFPB ) XXXX XXXX XXXX XXXX, IA XXXX Subject : Formal Complaint Regarding Irregularities in the Transfer and Management of My Mortgage Account ( # Loan Ending in XXXX ) Dear CFPB Representatives, I am filing a formal complaint against XXXX XXXX XXXX and Valon Mortgage for multiple irregularities and lack of transparency in the transfer and subsequent servicing of my mortgage loan. Despite numerous requests, neither servicer has provided the complete and detailed payment history required by law, nor have they conducted the necessary audits to ensure the accuracy of the account at the time of transfer. These failures violate both federal laws, including the Real Estate Settlement Procedures Act ( RESPA ) and the Truth in Lending Act ( TILA ), as well as Florida state laws regarding mortgage servicing and consumer protection. I request your intervention to ensure these entities fulfill their obligations and resolve this matter. Summary of Events Loan Transfer : In XX/XX/XXXX, my mortgage loan was transferred from XXXX XXXXXXXX XXXX to Valon Mortgage. XXXX XXXX XXXX failed to provide a complete payment history or conduct an audit of the account as part of the transfer process. Instead, Valon Mortgage received incomplete and fragmented information, as evidenced by their inability to provide a full breakdown of payments dating back to the loans origination in XX/XX/XXXX. Repeated Requests for a Complete Audit : Starting in XX/XX/XXXX, I have repeatedly requested a full and detailed payment history, including a breakdown of how payments were applied to the principal, interest, escrow, and other charges from the loans inception. Valon Mortgage has consistently avoided providing a full audit or verifying the accuracy of the data transferred from XXXX. Instead, they have cited limitations, including their inability to generate a historical amortization schedule or audit how additional principal payments impacted the loan. Escalations and Delays : Valon Mortgage has repeatedly delayed addressing my concerns. Most recently, on XX/XX/XXXX, they requested an additional XXXX XXXX for an investigation, continuing a pattern of delay that has persisted for nearly XXXX XXXX Impact of Incomplete Information : The absence of a complete payment history has created significant confusion regarding : How payments were applied prior to and after the transfer. How escrow funds were managed, including contributions and disbursements. How additional principal payments were allocated. This lack of clarity prevents me from verifying the accuracy of my account and raises doubts about whether XXXX XXXX XXXX conducted a proper audit before transferring the account. Violations Identified Federal Violations ( RESPA and TILA ) : Real Estate Settlement Procedures Act ( RESPA ) ( 12 U.S.C. 2605 ) : Requires loan servicers to ensure that all account information, including payment histories, is accurately transferred during a servicing transfer. Mandates that servicers provide a detailed and complete payment history upon request, including an explanation of how payments were applied. Both XXXX XXXX XXXX and Valon Mortgage failed to meet these requirements. Truth in Lending Act ( TILA ) ( 15 U.S.C. 1601 et seq. ) : Grants borrowers the right to understand how payments have been applied to their loan, including the allocation of principal, interest, and other charges. Valon Mortgages refusal to provide a full historical audit of my account violates TILA by hindering my ability to verify and understand the status of my loan. State Violations ( Florida Consumer Protection Laws ) : Florida Statutes Chapter 494 ( Mortgage Brokerage and Lending ) : Mortgage servicers are required to act in good faith and provide accurate account information to borrowers. The repeated delays and incomplete responses from Valon Mortgage constitute bad faith handling of my requests. Florida Deceptive and Unfair Trade Practices Act ( FDUTPA ) ( Fla. Stat. 501.201 ) : Prohibits unfair or deceptive practices in the conduct of trade or commerce, including mortgage servicing. The failure of Caliber Home Loans to provide a complete and accurate account history, combined with Valon Mortgages ongoing evasive responses, represents a potential violation of FDUTPA. Formal Requests I respectfully request the CFPB to take the following actions to ensure compliance with federal and state laws : Full Audit of the Loan : Conduct an independent audit of my mortgage account, detailing how all payments have been applied to the principal, interest, escrow, and other charges since the loans origination in XX/XX/XXXX. Review of the Loan Transfer Process : Investigate whether Caliber Home Loans conducted a proper audit of my account before transferring the loan to Valon Mortgage and whether Valon verified the accuracy of the transferred information. Escrow Account Analysis : Provide a complete breakdown of all escrow contributions, disbursements, and adjustments to ensure funds were handled accurately and in compliance with RESPA. Ensure Compliance with Legal Deadlines : Require Valon Mortgage to promptly respond to all future requests, adhering to the deadlines established under RESPA and other applicable laws. Conclusion The failure of Caliber Home Loans to provide a complete account history during the transfer, combined with Valon Mortgages evasive responses and repeated delays, has created unnecessary confusion and uncertainty. These failures have prevented me from verifying the accuracy of my mortgage account and represent clear violations of both federal and Florida state laws. Complaint What Happened I was notified on XX/XX/2024 ( via email ) by XXXX that my loan has been sold to a new Servicer- Valon Mortgage . On XX/XX/2024- I attempted to log into my account at Valon Mortgage and did not see my loan information. I contacted Valon and was told that the transfer of my loan data has not yet occurred but I will be notified once the transfer has been completed. On XXXX the XXXX XXXX I received an email from Valon Mortgage stating that my loan will be transferred from XXXX to Valon on XX/XX/2024 and there is nothing for me to do. On XX/XX/2024- I made my mortgage payment ( {$2000.00} ) to my XXXX account as usual.. On XX/XX/2024 I received an email from Valon stating that my loan has been officially transferred from XXXX and I must now Register Online. I proceeded to register online and did see all my l loan details- however the payment I made to my XXXX account on XX/XX/2024 was not reflected it showed me owing the XX/XX/2024 payment. I immediately contacted Valon and inquired as to how they will ensure that the payment made to XXXX will be transferred to my account at Valon in order to avoid a late payment or credit impact. I was told by a very " rude '' customer service representative " XXXX '' - that they will not be assessing any late fees until after XX/XX/2024.. HOWEVER.. as far as making sure the payment gets to Valon is my responsibility. I attempted to ask more questions but was told by the CS Rep that I needed to wait for her to finish telling me what she was trying to say. As a consumer- the transfer of my loan to a new servicer was not in my control and both ( XXXX & Valon ) organization has the responsibility to ensure all customer loan information has been transferred accurately. I have signed into my XXXX account- which now shows a loan balance of {$0.00} - and the fact that my payment was last payment was applied on XX/XX/2024.

Complaint What Happened After reading their nonsense, they are not telling the truth. I have both returned receipts back and both signed on XX/XX/2024, and XX/XX/2024, by XXXX. Remember a bank can not lend money. Truth in Lending Act Section 102, 15 USC Section 1601. My signature created the money. If you feel that the above law is not correct, then send me full copy of the corporate records, full booking of account records, full financial records, a copy of the check or accurate bank transaction that showed XXXX XXXX XXXX paid for the vehicle, a full copy of the promissory note wet ink signature and a promise to pay letter. If you can not produce all of these records, then my cease and desist stands and close my account until you can provide me with all the documents and especially a copy of the check during the transaction that you purchased my vehicle. I am not making payments when I know it was bought and paid for by me. Common law is the law of the land. Not contract law, it is illegal. TITLE 15 USC SEC 1 states all contracts are illegal. I never received a loan for this vehicle because I never signed a check for that loan of the vehicle or never received any money deposited into my account to pay for that loan. I signed a promissory note. Code 9-102A65 states it has no recourse to pay back. The loan was already paid for by me. That promissory note was monetized. TITLE 12 USC 83A states the promissory note that I signed was cashed in to purchase this vehicle. Who created the promissory note? I did. Prove that you loaned me the money? I need the bank transaction and a copy of the check that you purchased this vehicle. Remember, banks can not lend money. If banks can not lend money, how did you pay for this vehicle? How? I created all the money that paid for this vehicle, that is why you can't present a copy of the check and bank transactions to show that you paid for this vehicle. Look up powers and duties of banks. It does not say lend money ; it says borrow money. Who did they use to borrow the money. They used my social security number and signature and borrowed the money from me and you're trying to get me to pay it back.

Complaint What Happened On XX/XX/XXXX VALON mortgage paid {$5100.00} to XXXX XXXX tax to the wrong account. They paid parcel unit XXXX, my unit is XXXX out of my escrow account. On XX/XX/XXXX VALON paid {$5100.00} to XXXX XXXX tax again out of my escrow account to my unit XXXX. This caused a negative escrow balance of {$4900.00}. They transferred my loan to fifth third bank on XX/XX/XXXX with the negative escrow balance. I am selling my house and close on XX/XX/XXXX. The payoff statement from fifth third includes payoff if the negative escrow account. XXXX XXXX said they are refunding VALON the erroneous payment. VALON informed me that they will not reimburse me for the duplicate tax payment deducted from my escrow account. They have now said that I have to get the money from fifth third who were not the ones that paid the taxes to the wrong account and who will not receiving the refund check. I have also been told by VALON that they do not service my account any longer and do not hold any records of my account once loan has been transferred. I am now left with no help and out {$5100.00}. Please help me to get my money back for an error that the bank made. I am left with no help and no answers.

All my correspondences are on line via email since I don't check any physical mails and all my payments are set up as auto pay directly from my bank account for convenience so that I don't have to worry about being late, late payment fees and to keep healthy credit score!!! Recently, as of XX/XX/2024 XXXX XXXX sold the mortgage to " Valon Mortgage Inc '', which I was not aware of since I don't check any physical mails, as I have mentioned earlier. After receiving a " certified mail '' I came to know that the loan has been sold to the Valon Mortgage Inc. After receiving the letter I have reached out to Valon Mortgage Inc , paid two months of outstanding payments and set up an auto payment immediately, including a bi-weekly payment. Valon CSR even removed the late fee for one month and told me that I will not be considered late since I have cured the breach within 90 days. Soon after I made the payments, I found out from the credit bureaus that Valon reported my payment as late and my credit score dropped by more than XXXX points!!! After the incident, I have reached out to Valon CSR again and explained them the situation. The CSR apologised and told me that it shouldn't have happened, but she can't do anything since that's above her pay grade and suggested me that I should send an email to Valon corporate office and asking them to remove late payment notification from credit bureau at XXXX, which I did immediately on XX/XX/XXXX. Till todate I have not received any communication from Valon and it's hurting my credit and financial obligations.
