Complaint What Happened In XXXX of XXXX, we were told approximately 3 days prior to the targeted closing date that we would not be able to get the loan because he had only been at his job for 1 year and 8 months rather than 2 years. This information was known from the beginning of the loan application. We lost our earnest money, appraisal fee, inspection fees, etc. We had already hired movers and had to pay for extended storage. We were left homeless for around 4 months. The lender was also trying to use income for a rental property that was in the process of being sold. The company was Guild Mortgage in XXXX, Florida.

Complaint What Happened I was approved for Homeowners assistance program ( Haf ) for 18 months fwd pmts. XXXX pmt posted in XXXX with no problem and XXXX with no issue. XXXX XXXX was returned by bank and never resolved. Now I'm showing 1 month behind as each out that has posted since is covering the previous month for the missing XXXX XXXX. This is racking up late fees and hurting my credit. I have never been late on a pmt until haf. While I'm appreciative it's hurting me also. Then per guild mtg. My homeowners insurance tripled from XXXX to XXXX which increases my pmt XXXX per month. Haf covers XXXX I have to try to cover the rest but guild will not apply the haf pmt to my acct as it is seeing it as a partial payment. Complaint What Happened XX/XX/XXXX, put a contract on a home through Guild Mortgage, property address is in XXXX, sc XXXX XX/XX/XXXX, I did inspection for a streamline XXXX mortgage, total mortgage {$100000.00} XX/XX/XXXX, unknown to me, presidentially declared disaster damaged the home before we closed XX/XX/XXXX, I closed on my home but the lender did not do a post disaster inspection for damages as a result of the storm as required in FHA guidelines XX/XX/XXXX, contractor began streamline XXXX repairs but was unable to finish due to additional damage not included in the mortgage as a result of the storm XX/XX/XXXX, I was unable to even move in the home because the damage was so significant and severe, mildew and mold and flood damage, furniture was moved in and also damaged from mildew XX/XX/XXXX, retained an attorney to work with Guild Mortgage on getting the repairs done XX/XX/XXXX - XX/XX/XXXX, Guild Mortgage tried to put the responsibility for repairs on me. All the while, my attorney was in settlement negotiations with Guild Mortgage. Behind our backs, Guild mortgage applied for foreclosure in XXXX of XX/XX/XXXXXX/XX/XXXX, Guild mortgage had repairs assessed in the amount of {$160000.00}, the mortgage is only for {$100000.00}. Guild offered to take over the deed of the home in exchange for credit repair and a settlement of {$10000.00}.

Complaint What Happened Guild Mortgage used dishonest bait and switch tactics to acquire my business, have me pay for : -Home inspection -Boundary survey -Property Appraisal -Flood determination -Second survey for flood certificate ( Per loan investor request ) -Flood insurance ( Per loan investor request ) And once we 're far along in the process they make me change the loan product to something more expensive. Case Timeline : XX/XX/XXXX GUILD sent me a pre-qualification letter for a Jumbo XXXX ARM loan ( 4 % rate / 5 % down ) XXXX XXXX I found the house I want to buy and I make an offer. XX/XX/XXXX I sent to GUILD a copy of the executed sales contract. The closing date is set for XXXX XXXX. GUILD told we can close in that date. XX/XX/XXXX GUILD sent me a loan estimate to sign XXXX XXXX GUILD sent me a loan estimate with the rate locked ( 3.875 % rate / 5 % down ) XX/XX/XXXX ( closing day ) GUILD was nor ready to close and asked to reschedule the closing to XX/XX/XXXX XX/XX/XXXX GUILD sent me the closing disclosure XX/XX/XXXX ( after 45 days of the offer acceptance and 4 days before closing ) GUILD notified me that the " loan investor '' can not approve my loan and the main reason was : " Investor not using any rental income from current property since it shows up on only most recent year of tax returns and two year history could not be established ... no exceptions. '' This is unacceptable, I got a pre-qualifiation letter and after my loan was approved and reviewed by the lender 's underwriters I got a loan estimate and a closing disclosure document. It 's my understanding this is what underwriters do, they validate all the loan requirements and they should know what is the investors guidelines for each loan product. At this point GUILD offered me another product of course now this is more expensive. XXXX Mortgages XXXX with 4.5 % rate and another with 4.625 % rate. And now I have to put 10 % down. This extra 5 % was a big hit on my family savings and it 's causing financial struggles in home. At this point I do n't have another option to accept this new loan product. I was on risk of losing the house my family want. ( Seller have other offers ). If I went to another lender I would have to start over all the process. XX/XX/XXXX GUILD sent me the closing disclosures for the new loans. Closing date set for XX/XX/XXXX The effective closing date was XX/XX/XXXX
