Description |
ORDERED that, within ten (10) days from the date of this order, Appellant shall file in this court a brief statement explaining the basis for this court's subject matter jurisdiction over the order appealed in this case, citing supporting legal authorities. Appellant shall specifically address how the November 11, 2024 "Order Denying Defendants' Irrevocable Election to Purchase Plaintiff's Interest" is an appealable final order, in that it states Count I of Falcon Endeavors, Inc.'s Petition remains pending. See Fla. R. App. P. 9.110; see also Pellegrino By and Through Pellegrino v. Horwitz, 642 So. 2d 124 (Fla. 4th DCA 1994) ("An appeal from an order dismissing one count of a complaint, where other counts against the same parties remain, is authorized only when the dismissed count arises from a separate and distinct transaction independent of the other pending pleaded claims.") (citing Mendez v. West Flagler Family Ass'n, 303 So.2d 1 (Fla. 1974)). Further, address how the order is an appealable nonfinal order pursuant to Florida Rule of Appellate Procedure 9.130(a)(3)(C)(ii). See Fla. R. App. P. 9.130(a)(3)(C)(ii); ; see also Pineside Condo. Ass'n v. Rey, 342 So. 3d 741 (Fla. 3d DCA 2022) ("Appeals of nonfinal orders that fall outside the scope of Florida Rule of Appellate Procedure 9.130(a)(3) must be dismissed.") Further, Appellee may file a response within ten (10) days of service of that statement.
