I purchased a vehicle in XXXX of XXXX with a down payment of {$20000.00} I was originally told by the dealership that the internet rate would be 12 % only to later find out that it was 13.87 %. I hit a hardship where I had to make substantial repairs to the vehicle which cased me to fall behind on payments. I was 2 months behind on the payment as a result of this at the time. I was attempting to contact the lender who is XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX, MA XXXX. I was unsuccessful in my efforts to speak with them. Every time I called I got the automated service. The vehicle was repossessed on XX/XX/XXXX. Upon my attempts to pay my past due balances and retrieve my vehicle I was told that they would not accept the payment but instead wanted the entire balance owed on the loan which is {$32000.00}. I attempted numerous times to get in touch with someone in charge that could resolve the matter and was not able to. I believe that throughout this entire debacle I was handled incorrectly and harmed in several ways.

On XX/XX/XXXX of the current year, my son and I took a car from a Dealer called The Taverna Collection located at XXXX XXXX XXXX XXXX, XXXX XXXX, Fl XXXX, the executive who attended us at that time was named XXXX XXXX XXXX.
XXXX days later the young Executive communicates with my son and tells him the need to sign a second contract ( XXXX XXXX ) because the first XXXX had some errors because they had made a mistake in the company that would finance the purchase, we agreed to the signing of the second contract with a second financier because we already had the car in our possession and the young man argued possible problems for him in his work, appealing to our sensitivities we ended up giving in. The next day the young man sends us a new text message because it was necessary for us to show up at the Dealer, at that time I was leaving for trips for personal reasons and it is my son who goes to said appointment pressured with threats that argued the return of the car if we did not attend, as my son told me that day there he was attended by the general XXXX of sales of the company, a man named XXXX XXXX in the company of another gentleman who asked him for the car key card and returned it to him as soon as I left and returned from the place, the reason for the meeting was to talk about the need to sign a third contract, which was electronically signed by me because I was out of town.
Now the reason for my complaint is that currently, XXXX weeks ago, they took the car from our entrance and the company that took it ( LENDBUZZ FUNDING LLC ), argues that it is due to non-payments in the last XXXX months of XXXX that we supposedly have a financing contract with them, the previous errors made me think that they were another financier and that the payments were being automatically discounted as they had told me it would be in the Dealer previously, these errors have caused a misunderstanding and in turn there was never a formal communication with the company Car financier, according to them they made calls but it is uncertain we did not even know for sure that they existed because the confusion made us think that it was another financier, after the confusion I discovered in my spam tray a couple of emails for late payments that were never read on time but no email or even introductory phone call at the end of our contract signing as is normally done to be sure of the terms and agreements previously signed without them, we never knew that they were the company that financed the car [ 2022 XXXX Model XXXX ( XXXX ) ], everything The above brought with it three-month delays in car payments. The company argues that it was in contact with us at some point which is uncertain never before we talked to them but until we got in touch after they took the car and tried to call the potential financiers, thus discovering that it was them, and in turn trying to fix the misunderstanding proposing to make a payment agreement with them whose solution at the beginning of the month is to pay {$2000.00} within XXXX days, in the last days they avoid calls and ignore in our case, they even hang up the calls, making it extremely impossible for us A solution that does not damage any of the parties. The mistakes made by the dealer with the execution of XXXX different contracts caused confusion in XXXX, added to the lack of communication and professionalism of the financing company that never formally presented itself and much less checking the terms and conditions of our supposed signed contract, along with my irresponsibility for not having been duly attentive to my duties as owner, for not having renounced at the time to the signing of XXXX additional contracts to the first and for having delegated my duties to my son because of my trip, were the reasons that led to abruptly stripping me Of the car and in turn have generated threats by the financing company with possible debts that they will send to XXXX and in this way ruin my XXXX XXXX due to mistakes made by all those involved, but for which no one wants to take responsibility, leaving all the blame on me and being the most affected party.

I am writing to formally request a reinvestigation of late payment notations on my account LENDBUZZ # XXXX, referenced above, which were previously confirmed by your institution in response to a dispute initiated with the credit reporting agencies. The dates of the reported late payments are as follows :XX/XX/2023 XX/XX/2023 XX/XX/2023 XX/XX/2023 I respectfully request that the company reinvestigate these late payment entries under the provisions of the Fair Credit Reporting Act ( FCRA ), particularly focusing on the following : Accuracy and Completeness of Reporting - Under FCRA Section 611 ( a ), consumers have the right to request a reinvestigation of information on their credit reports. You are required to ensure that the information provided is accurate and verifiable, especially in light of FCRA Section 623 ( a ) ( 1 ) ( A ), which mandates that furnishers of information must not report information that they know or have reasonable cause to believe is inaccurate. Furthermore, under FCRA Section 611 ( a ) ( 5 ) ( A ), any unverifiable or inaccurate information must be corrected or deleted within 30 days of receipt of this reinvestigation request.
Reasonable Investigation Procedures- As outlined in FCRA Section 623 ( b ) ( 1 ), furnishers of information are required to conduct a reasonable investigation of disputes and must report the results to the consumer reporting agencies. If your records do not fully substantiate the late payment entries, these must be corrected and removed from my account and updated with the credit bureaus.
Validation of Billing Practices - Additionally, I request validation of compliance with 15 U.S.C. 1666 ( b ) concerning the timely mailing of periodic billing statements. It is my understanding that billing statements must be delivered not later than 21 days before the payment due date, per the Truth in Lending Act ( TILA ). I kindly ask that you provide documentation evidencing compliance with this requirement for the dates in question.
Procedures to Ensure Accuracy - Per 15 U.S.C. 1681e ( b ), consumer reporting agencies and furnishers are obligated to maintain reasonable procedures to ensure the maximum possible accuracy of the information being reported. I am requesting an explanation of the procedures your institution follows to guarantee the accuracy of the late payments reported to the credit bureaus.
Please provide a detailed response regarding your findings, including copies of all documents used to verify the late payments and the procedures followed during the reinvestigation.

Dear Lendbuzz Pursuant to 15 USC 1681A ( K ) your company Lendbuzz have taking adverse action against me On XXXX XXXX / 2021 Clearly where federal law states it is a violation of my consumer rights, its clearly states 15 USC 1681 B ( A ) intends to use the information in connection with a credit transaction involving the consumer on whom the information is to be furnished and involving the extension of credit. it doesnt mentions a denial of credit it only mentions being denied for insurance or employment 15 USC 1681 A ( K ) ( i ) ( ii ). Your company used my credit card ( AKA SSN ) 16 CFR 433.1 ( h ) Credit card issuer. A person who extends to cardholders the right to use a credit card in connection with purchases of goods or services. In a consumer credit transaction 12 CFR 1002.2 ( h ) Consumer credit means credit extended to a natural person primarily for personal, family, or household purposes. I did not received & benefit in this transaction which is identity theft Pursuant to CFR 1026.12 ( B ) ( 1 ) ( i ). Your Company Lendbuzz said in there letter that the reporting agency played no part in your company decision and cant supply specific reasons of why Lendbuzz denied me credit and then False and Misleading me the Consumer by saying your company Lendbuzz decision was based in a whole or in part on information that came from the consumer reporting agency which is XXXX. Pursuant to ECOA ( Equal Credit Opportunity Act ) Regulation that aims to give all legal individuals an equal opportunity to obtain loans and other types of credit from financial institutions/ lenders under Title 15 your company Lendbuzz are prohibit by lenders in any aspect of granting credit to an individual. The acts purpose is to prevent lenders from using race, color, sex, religion or other non- creditworthiness factors when evaluating a loan application, establishing terms of a loan, or any other aspect of credit transaction. Organizations that have shown a pattern of discrimination can have lawsuits brought against them by the Department of Justice. CFR 1002.7 Rules concerning extensions of credit ( a ) Individual accounts. A creditor shall not refuse to grant an individual account to a creditworthy applicant on the basis of sex, marital status, or any other prohibited basis Lendbuzz your False and Misleading me the Consumer your company accept my credit application but claim Your company Lendbuzz denied me the consumer credit Im giving you a opportunity to cure this matter 15 USC 1691 ( b ) Activities not constituting discrimination It shall not constitute discrimination for purposes of this subchapter for a creditor ( 1 ) to make an inquiry of marital status if such inquiry is for the purpose of ascertaining the creditors rights and remedies applicable to the particular extension of credit and not to discriminate in a determination of credit-worthiness.

So according to your understanding of the alleged agreement how much actual cash value must the bank loan to the borrower in order for the bank to legally fulfill the agreement and legally own the promissory note?
So according to your belief if the borrower signs the promissory note and the bank refuses to loan the borrower {$16000.00} actual cash value would the bank or the borrower own the promissory note? The borrower Do you believe the borrower agreed to provide the bank with {$16000.00} Of actual value which was then used to fund the {$16000.00} bank loan check back to the same borrower and then agreed to pay the bank back {$16000.00} plus interest?
So if this happened in your opinion would the bank legally own the promissory note and be able to force XXXX to pay the bank interest and principal payments?
Well is it bank policy that when a borrower receives a {$16000.00} bank loan the bank receives {$16000.00} actual cash value from the borrower that this gives value to a {$16000.00} bank loan check and then this check is returned to the borrower as a bank loan which the borrower must pay?
Is this normal policy?
Do you believe the agreement between XXXX and the bank is that I provide the bank with an actual cash value of {$16000.00} which is used to fund a {$16000.00} bank loan check back to myself which then am required to repay plus interest back to the same bank?
Did you not say earlier an ordinary person can use ordinary terms and can understand this written agreement?
Is there anything in this agreement showing that the borrower had knowledge or showing the borrower gave the bank permission or authorization for the bank to receive {$16000.00} In actual cash value from the borrower in the note and to use this to fund the {$16000.00} bank loan check which obligates the borrower to give the bank back {$16000.00} plus interest?
If the borrower provided the bank with actual cash value of {$16000.00} in the note which the bank used to fund the {$16000.00} check and return the check back to the alleged borrower as a bank loan check in your opinion did Bank loan {$16000.00} to the borrower?
So if a bank customer provides actual cash value of {$16000.00} to the bank and the banker returns {$16000.00} actual cash value back to the same customer is this a swap or exchange of {$16000.00} for {$16000.00}?
