XX/XX/2022 a payment of XXXX was made after company purposely made late fees come in hand. After company withdrew and confirmed payment weeks later the payment came up as invalid and still not returning the money after had already taken it. Looked on online for reviews of Company Driveway Finance and seems like theyre known to scam their customers. Along with taking your money and causing late fees to occur on purpose, the customer service dont know what theyre doing and lie about errors, payment refund and late fees being deducted.

On XX/XX/2023 my credit was used to get a loan in the amount of {$44000.00} on a car through LithiaXXXX XXXX XXXX XXXX The car was sold to an XXXX XXXX. I have called the company to their numbers and have not been able to speak to a person as the recording of music will go on for hours with no one receiving the call ( XXXX ) XXXX. This loan is to a person by the name XXXX XXXX, I have never met anyone by this name nor would I contract with another person financially.

A vehicle I had with this company was repoed 4 months ago because I was unable to afford it because of the interest. However since the vehicle had been taken 4 months ago they have no yet sent it auction to settle the account and continue to let it devalue before they sell it. Additionally they are continuing to charge me late fees and penaltys even though they have and had possession of the vehicle for 4 months. This is unethical and out if control.

For several months, the account DRIVEWAY FIN ( XXXX ), which refers to a repossession, has been reported on my credit history consistently, being a significantly negative aspect for my finances. This vehicle was repossessed ; however, this repossession was carried out without notifying me in advance, which is something I still have not received information about. If it was taken back by the creditor, they continue to report an outstanding balance equal to my last payment, which is perplexing for me since the repossession should have counted as coverage for the debt. I should have been notified if it was auctioned or not, but this has not been clarified. I filed various disputes with both the credit bureaus and the creditor at the time ; however, I have not received any response from them, which has forced me to submit this complaint. I consider it unfair and a violation of my rights that this account is negatively affecting my credit when the circumstances were triggered against me. Additionally, I must say that the account is reporting inaccurate and incomplete information among the three credit bureaus, which amplifies the number of violations of my rights. Upon researching my case, I found that the company is infringing sections of 15 USC : 15 USC 1681e ( b ) : The information provided to consumers is inaccurate, misleading, or incomplete.
15 USC 1681i ( 5 ) : Failure to conduct a reasonable investigation into disputed information.
15 USC 1681 ( a ) : The inaccurate and misleading information contained in the credit report violates the FCRA 's requirement for fair and accurate reporting.
15 USC 1681 ( a ) : The failure to investigate and correct these inaccuracies within a reasonable time frame is a violation of the FCRA.
15 USC 1681s-2 ( a ) ( 2 ) : Furnishing information to a consumer reporting agency without the consumer 's written instructions.
15 USC 1681n : failed to provide me with clear and conspicuous notice of my rights under the FCRA.

On XX/XX/2023 we traded in our XXXX XXXX that was financed with Driveway Finance. On that day I logged into my online account with Driveway Finance and provided the dealership with the payout amount. Our next payment was due on XX/XX/2023. On XX/XX/2023, Driveway Finance deducted {$360.00} from my account. When I noticed and logged online, my " auto-pay '' was turned off. I called Driveway and I was told that the new bank ( XXXX ) did not pay the total amount and I was charged with the difference which included a late fee for the XX/XX/XXXX payment, a returned check for the XX/XX/XXXX payment, and a late fee for the supposed XXXX payment that I was not even aware. The representative informed me that XXXX sent a payment of {$33000.00} and the total payout was {$33000.00}. The XX/XX/XXXX late fee was {$31.00}, the return fee {$25.00} and the XXXX late fee was {$39.00}. The numbers simply don't match.
So I asked the representative to provide me with a statement with a complete history of payments, dates and loan information. She informed me that she would need my personal email because the email on file is my work email and per policy they can not send to a work email or business. I questioned the reason because I used my work email to create the account online and have received emails from Driveway Finance in the past.
My complaints are the following : XXXX Lack of information available to consumer. The portal where we access the account does not show payment history, fees or any other essential information related to the original loan.
XXXX Lack of communication. I have not been emailed or received a letter notifying me that I still owed them money.
XXXX Unauthorized charge. My account auto-pay was turned off and yet I was deducted money.
XXXX Lack of transparency with consumer related to information request. If a work email or business email can be used to open an online access, therefore the same email should be used to receive documents related to the account.

I have purchased XXXX XXXXXXXX XXXX at XXXX XXXX back on XX/XX/XXXX. During my purchase I was misled into purchasing the add ons I didn't need and stated so during the purchase. However, I didn't realize that they were added to the total vehicle 's price up until I got my first bill a month later. XXXX XXXX was the one to sell me those add ons and to mislead me by saying I'm only paying a small amount each month and not providing me the final amount or itemized receipt at the end of the transaction, which would list thousands of dollars that I was taking in loans in addition to the car price.
When I received my first bill I noticed my total owed was very large, so I contacted XXXX XXXX asking why was I being charged all this money, as he gave me his number and told me to call if I had any questions. However, XXXX would not answer any questions. He was very rude, insulting me and refused to talk to me. I ended up going to the dealership in person and asking to speak to someone because even though being present there XXXX would not acknowledge me and even though he did not have anyone at his office, he said was very busy. I ended up speaking to XXXX XXXX - sales representative, at the office right next door to XXXX 's. I told XXXX that I would like to cancel the add ons as I had no idea about the total amount I was actually paying. XXXX asked XXXX to cancel them. XXXX said he couldn't as his computer system was down. After which XXXX told me to write them an email and include the owner of the dealership XXXX XXXX on it. I did write the email to all three of them asking to cancel my add ons and describing what happened, to which I received 3 emails from XXXX accusing me of bothering him and demanding to tell him who referred me.
After not receiving any help from the dealership, I found customer service numbers for the companies I had the add on contracts with and had to call and email them asking to cancel my add ons. A few days later I received confirmation that my add on contracts were canceled. I'm attaching the proof of this to this email. XXXX XXXX & I told me that they have also contacted XXXX XXXX in the beginning of XXXX last year informing them that they have cancelled their contract add ons with me.
My loan has been placed with Driveway Finance Corporation. I have called them multiple times asking if they have received the refund checks from the dealership and adjusted my balance. In the beginning Driveway Finance Corporation was telling me to wait for 6 - 8 weeks noting that they could still see the add ons on my account. However, when I called at the end of the wait time period they said there was no record of my cancelled add ons at all and they can only see 2 active add ons ( out of 5 original ) as of that moment. However, my balance hasn't been reduced/readjusted at all.
Please see the proof of my cancellations attached. As of now, I'm still paying for the add on contracts I don't have and the interest is still being added based on the total higher price as well.
In addition XXXX XXXX XXXX and Driveway Finance Corporation are under the same company umbrella - XXXX. Nevertheless, there is a huge lack of communication regarding the refund of the money for the cancelled add ons.

I put {$3000.00} down and the rest was financed thru Driveway Finance Corporation ( XXXX XXXX XXXX XXXX XXXX OR XXXX ). On XX/XX/XXXX I received a welcome letter from Driveway Finance Corporation with details of my account, how to sign up online for an account to manage the account and make payments. I set up an online account. The first payment was due XX/XX/XXXX. I made my payment online on XX/XX/XXXX. Its now XX/XX/XXXX and the payment has not processed. I have called each day to Driveway Finance Corporation to the only number provided ( XXXX ). Thru the automated system I am transferred to a representative line which plays a song continuously with no answer. I have even tried the " title message box '' and left a voice message in hopes someone will contact me. I have called my bank and they have verified that no attempts from this company has been made to my account for payment. I have called the dealership multiple times and no one returns my calls. Online, on my account, it shows in the " payment history '' that the payment was made however it also shows that the payment is now overdue, accruing daily interest for payment now posted to account.
