Complaint What Happened The company was XXXX XXXX Loan officer XXXX XXXX He told me on since before XX/XX/XXXX that I had been approved for a {$120000.00} at a 3 % interest rate. He had all of my info I had filled out an application and all. On two separate occasions I did a inspections on houses thinking that this process would work. The most recent was XX/XX/XXXX he told me everything with the loan good to go that I could continue with an inspection on the house. I signed a contract with the owner of the house stating the XX/XX/XXXX would be our closing date. I paid {$350.00} for an inspection and {$50.00} for a reinspection. I paid my escrow and found insurance for the house all under his instructions. He told me he ordered an appraisal around XX/XX/XXXX no appraiser ever contacted my realtor to make an appointment he said he cancelled it and ordered another one through another company around XX/XX/XXXX again no one contacted us so he said he switched the company for a third time and had an appraisal scheduled for XX/XX/XXXX the closing date. On XX/XX/XXXX I received multiple messages from him asking be for multiple documents I had already sent him drivers license, social security, insurance info, proof of employment, exc when he sent me the documents it was another application my husbands info was all wrong the closing date was wrong and the loan amount and interest rate was wrong. I tried explaining to him the contract ends XX/XX/XXXX and I thought all this paperwork was done. He refused to acknowledge anything I was asking him. I then received the first of any notification saying he ordered an appraisal XX/XX/XXXX at XXXX and said he would have everything done by the following day. I again stated we could not wait because the contract expired that day. He better brushed me off saying I needed to then get ahold of the title company. I tried to get help from another lender after telling XXXX I will no longer need his services and the other lender told me I did not even have a case number. XXXX lied about everything that had to do with my paperwork and loan costing me, the owner and my realtor money and time.

Complaint What Happened I am XXXX XXXX ( XXXX XXXX ), and I am submitting this complaint and there is no third party involved. I, XXXX, am a natural person consumer, and original creditor of an open-end credit plan was denied the right of disclosures to include the right of rescission as well as other violations of several sections of United States Code Title 15 chapter 41 consumer protection laws by Gateway Mortgage Group a division of Gateway First Bank , a debt collector, by unfair, deceptive, and abusive practices against me a consumer by misrepresentation of consumer credit transaction 15 U.S. Code 1641 ( c ) ; ( g ) ( 2 ) as unfair practice to deprive me consumer of informed use of credit and right of rescission of 15 USC 1635 ( a ). On XX/XX/2022 received complaint response from XXXX XXXX Financial Examiner/Analyst II Division of Consumer Finance Office of Financial Regulation for case number XXXX who advised to pursue remedy via Oklahoma State Banking Department who returned a response the day following the foreclosure sale as exhibited by the uploaded supporting documents. On XX/XX/2022 the debt collector initiated an illegal action following several complaints for violation of my right of rescission and violation of the privacy Act by furnishing without consent my personal health information to unaffiliated third parties in violation of 15 USC 1692c ( b ) and by implication of communication by attorney in violation of 15 U.S.C. 1692e ( 3 ) in dishonor my exercise of my right of rescission pursuant to 15 U.S. Code 1635 ( i ) ( 1 ) ( B ) as a result of 15 U.S.C. 1692e ( 2 ) ( A ) ; ( B ), unlawful conversion of my consumer credit transaction to foreclosure on my place of abode misclassified as real property by 15 U.S.C. 1692j ( a ) deceptive forms by summons IN THE CIRCUIT COURT OF THE SEVENTEENTH JUDICIAL CIRCUIT, IN AND FOR XXXX XXXX, FLORIDA CIVIL DIVISION CACE XXXX in effort to justify failure to comply with 15 U.S. Code 1635 ( i ) ( 1 ) ( B ) pursuant to 15 U.S.C. 1692e ( 1 ) ( 3 ) in the implication bonded attorney, uniform judge and magistrate, and process service badge. I have been harassed, humiliated and disgraced as a consumer by the imposition of abusive practices by debt collector fail to produce a rescission form in compliance to 15 U.S. Code 1635 ( a ) exempt from foreclosure/dispossession into the docket as evidence of compliance to validate U.S. Code 1692f ( 6 ) ( C ). Plaintiff was awarded final judgement, and certificate of sale was made to XXXX XXXX XXXX, on XX/XX/2022 despite fulfillment of statutory right of redemption by consumer.

Complaint What Happened Our mortgage lender ( XXXX XXXX Mortgage, Oklahoma ) XXXX putting our payments into another unknown account at some point. We didnt know until we started the process to sell the house and were told we were in default and going into foreclosure after not paying for several months. We asked them how it is possible. No one knew anything. Finally we were told they could see our payments were made, but they went into another account and did not count toward our mortgage. We called many, many times, and no one could tell us the account the monies went to, why that happened, and they would not track it and apply it to our loan. They stole many payments and refused to give it back and we ended up paying considerably more for our house to sell than we bought it for XXXX years prior because we had to pay them the money that they had already confessed to taking but couldnt find. Our credit has suffered, they refuse to remove it from our reports, and no lender will give us a mortgage. My family has suffered immensely for over a year and a half and my family struggles have made it so we have gotten to point of separating the family. We cant be the only ones they did this to, but after all the fighting and praying, we know that our government has no rules in place with regard to mortgage companies stealing and harming consumers. We have gone through the process of disputes, but the bureaus just say the same thing, that XXXX says they are right. Thats all. No investigation, no questions. Why dispute anything at all?

Complaint What Happened I, XXXX XXXX , am submitting this complaint by myself and there is no third party involved. I, XXXX XXXX , natural person, consumer, alleged obligor, and original creditor of an open-end credit plan extended via my credit card for a consumer credit transaction to Gateway Mortgage Group on my behalf via a deceptive form that converted my interest a consumer and creditor unlawfully as borrower. I am the card issuer and cardholder for the accounts payable issued via consumer application as valuable accounts receivable. I granted the security interest to as debtor for the consumer credit transaction. Gateway usurped my credit and proceeds via account receivable secured credit application. I was coerced in completing a promissory note in the refusal of my endorsement by closing agent of the promissory note compelled for a blank endorsement as an illegal restraint. I issued a security despite being original secured creditor to consumer credit transaction. Despite misrepresentation of consumer credit transaction, Gateway has been advised to comply with my right of 12 CFR 1016 privacy and confidentiality and to cease the role of consumer reporting agency and communication with third persons, XXXX, XXXX, XXXX, XXXX etc. viz. consumer reporting agencies. Gateway has disregarded my revocation of right to report and continues to violate my right of privacy. Gateway has noticed of this billing error and has not responded. See FTC report attached regarding 15 USC 1679b ( a ) prohibited practices.

Complaint What Happened I, as consumer, having first hand knowledge, beneficiary employing the Full Faith and Credit STATE OF FLORIDA non-citizen XXXX person as authorized representative extended credit to Gateway as assignee for a consumer credit transaction and permitted Gateway to obtain a consumer report without complete disclosure 31 CFR 1.32 ( c ). Gateway breached trust in infringing copyright in my property and furnished fraudulent reports in misrepresentation of finance charges and balances and using my personal information for profit without my authority as an ultra vires act via deceptive misdescriptions. No person shall publish, print, display or otherwise publicly use for purposes of trade or for any commercial or advertising purpose the name, portrait, photograph, or other likeness of any natural person without the express written or oral consent to such use given by : ( a ) Such person; or ( b ) Any other person, firm or corporation authorized in writing by such person to license the commercial use of her or his name or likeness. see Florida Statute 540.08. GATEWAY refuses produce evidence of consent or by what authority requires disclosure without consumer consent. see 31 CFR 1.32 ( c ). Identity theft means a fraud committed using the identifying information of another person without authority. 12 CFR 1022.3 ( h ). Gateway has made false statements alleging ultra vires claim to publish, print, display or otherwise publicly use for purposes of trade or for any commercial or advertising purpose the name, portrait, photograph, or other likeness of any natural person. Gateway has refused to comply with my cease and desist demands. Gateway has been notified and continues to harass me with communications and refuses to respond to written disputes for disclosures in compliance for the Fair Credit Billing Act, Truth in Lending Act disclosures demanded that were withheld regarding the finance charge and the amount financed. Gateway refuses to disclose documentary material disclosing federal or respond to communications delivered in writing, proceeds held on behalf of obligor, fund approved and acquired on behalf of consumer. Gateways negligence has been very distressing and has put a strain on my personal life in dispute with Consumer reporting agencies. Gateway has threatened foreclosure alleging default as obscene language to disgrace the consumer despite demand for validation of debt compliance to Fair Debt Collection Practices Act. We anticipate Gateway will in good faith with clean hands address the claim brought forth.
