Subtype Order on Miscellaneous Motion
Description Deny Miscellaneous Motion-79a ~ In the November 7, 2022, "Letter/Motion," received by this court on November14, 2022, and docketed in case number 2D22-3700, the petitioner alleged that hemailed several documents "that were never acknowledged as being received by youand was told that they were not received and filed by you." The petitioner listed thefollowing: A "motion for leave to file and motion to file a new direct appeal and orbelated appeal in re denial of motion to recuse" mailed September 6, 2022. An"emergency petition for writ of habeas corpus" mailed October 3, 2022. An "expedited oremergency petition for writ of habeas corpus" mailed October 4, 2022. An "emergencypetition for writ of habeas corpus and addendum" mailed October 24, 2022.The "motion for leave to file and motion to file a new direct appeal and or belatedappeal in re denial of motion to recuse" was received by this court on September 9,2022, along with the petitioner's "motion for reconsideration of original denial order of11/09/1994 and motion to amend motion for rehearing dismissal order of 8/24/2022." Itwas docketed in case number 2D22-2368, the petitioner's proceeding initiated with anuntimely petition alleging ineffective assistance of appellate counsel. This court deniedthat motion on September 20, 2022, and served the order on the petitioner. On October 11, 2022, this court received the petitioner's October 4, 2022,"expedited or emergency petition for writ of habeas corpus," two affidavits written the bythe petitioner, and a "petitioner's open letter to the court." Attached to the "petitioner'sopen letter to the court," was an "emergency petition for writ of habeas corpus," whichraised procedurally barred claims of ineffective assistance of appellate counsel and trialcourt error. It was not clear from the "petitioner's open letter to the court" that theattached "emergency petition for writ of habeas corpus" was intended as a distinctpetition for writ of habeas corpus and not as an exhibit related to the claims referencedin the letter. Each filing listed circuit court case number 1991-CF-19920 in the caption, and each was docketed it in case number 2D22-3306. On November 9, this courttreated the "expedited or emergency petition for writ of habeas corpus," affidavits, and"emergency petition for writ of habeas corpus and addendum," as a petition for writ ofhabeas corpus and amended petitions for writ of habeas corpus and denied them.To the extent that this court did not consider the "emergency petition for writ ofhabeas corpus" attached to the "petitioner's open letter to the court" as a distinct petitionfor writ of habeas corpus in in case number 2D22-3306, the copy of the "emergencypetition for writ of habeas corpus" attached to the November 7, 2022, "Letter/Motion," isdeemed filed in case number 2D22-3700 and is denied. This court notes that the petitioner's repetitive filings have burdened the limitedresources of this court. The petitioner should be aware that there can be consequencesto such filings, including an inability to obtain review of future pro se appeals andoriginal proceedings, see State v. Spencer, 751 So. 2d 47, 48-49 (Fla. 1999), anddisciplinary procedures pursuant to the rules of the Florida Department of Corrections.See § 944.279(1), Fla. Stat. (2022); Harris v.
