Description |
Grant Miscellaneous Motion-79 ~ Respondent's motion to determine confidentiality is granted in part and denied inpart. As to pages 154-74, 213-33, 243-57, 305-19, 326-45, 346-47, and 353-77 of theunredacted response appendix, the motion is granted. These portions of the appendixshall be held as confidential pursuant to the trial court's April 20, 2020, protective order.See Fla. R. Gen. Prac. & Jud. Admin. 2.420(g)(8). The redacted response appendix isnot confidential because it is redacted. The parties' names, this court's administrative file, and the court docket aredetermined not to be confidential. The court finds that no less restrictive measure isavailable to protect the confidentiality of these items and that the degree, duration, andmanner of confidentiality ordered herein are no broader than necessary to protect suchconfidentiality. The clerk of this court shall seal the record pages identified above and keep themfrom public access. Only the attorneys for the parties, the judges of the court, the staffof the judges to which this case is assigned, and as necessary the court's clerical staffmay view the materials determined as confidential by this order. It is further ordered that, within 10 days from the date of this order, the clerk shallpost a copy of this order on the clerk's website for a period of 30 days to provide publicnotice. As to the response, the motion is denied without prejudice. The motion arguesthat the entire response is confidential. However, the court concludes that although theresponse contains confidential information, the entire document is not confidential. Thecourt will hold the response as confidential for 10 days from the date of this order, afterwhich the confidential designation will be removed unless the respondent files anamended motion to determine confidentiality of court records specifying the preciselocation of the confidential information. See Fla. R. Gen. Prac. Jud. Admin.2.420(d)(4)(C).

Description |
Deny Miscellaneous Motion-79a ~ Respondent's motion to determine confidentiality is treated as a notice of confidential information within court filing in part and denied without prejudice in part. As to the January 5, 2021, transcript located at pages 3-55 of the appendix to the response, the motion is treated as a notice of confidential information within court filing and accepted. The transcript will be held as confidential. As to the response, the motion is denied without prejudice. Although the motion identifies the location of the confidential information by page number, it fails to identify with specificity the precise location of the confidential information. See Fla. R. Gen. Prac. & Jud. Admin. 2.420(d)(4)(C). Accordingly, the motion is denied without prejudice to filing an amended motion that identifies the precise location of the confidential information in the response. The response will be maintained as confidential during the ten-day period.

Order on Miscellaneous Motion
|
Description |
Grant Miscellaneous Motion-79 ~ In this certiorari proceeding to review an order compelling production of information regarding alleged trade secrets, petitioner's second amended motion to determine confidentiality and to seal information filed on December 16, 2021, is granted to the extent that the second corrected petition and the appendix to the second corrected petition for writ of certiorari (filed under seal) are deemed confidential. See Fla. R. Gen. Prac. & Jud. Admin. 2.420(c)(9)(A)(ii). The parties' names, this court's administrative file, and the court docket are determined not to be confidential. The court finds that no less restrictive measure is available to protect the confidentiality of these items and that the degree, duration, and manner of confidentiality ordered herein are no broader than necessary to protect such confidentiality. Future filings by the parties should either be redacted or accompanied by a notice of confidential information within court filing to protect the information determined to be confidential by this order. The clerk of this court shall seal the petition and corrected petition and keep them from public access. Only those designated in the trial court's protective order dated April 20, 2020, the judges of the court, the staff of the judges to which this case is assigned, and as necessary the court's clerical staff may view the materials determined as confidential by this order. It is further ordered that, within 10 days from the date of this order, the clerk shall post a copy of this order on the clerk's website for a period of 30 days to provide public notice.
