On XX/XX/2022 at XXXX EST WakeField & Associates Violated my rights Under 15 U.S.C 1692c Section A : of the Fair Credit Reporting Act and the Fair Debt Collection Practices Act that states : Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt and continued Under 15 U.S.C 1692c 805 A1 at any unusual time or place or a time or place known or which should be known to be inconvenient to the consumer.
They also violated my rights under 15 U.S.C 1681 section 602 A. which states : I have the right to privacy.
And Under 15 U.S.C section 1681n section A and Section 1A states : Any person who willfully fails to comply with any requirement imposed under this subchapter with respect to any consumer is liable to that consumer in an amount equal to the sum of ( 1 ) ( A ) any actual damages sustained by the consumer as a result of the failure or damages of not less than {$100.00} and not more than {$1000.00} WakeField & Associates called my personal phone number WITHOUT my consent and while I was AT WORK and HARRASSED me to pay a debt, I am now vividly XXXX XXXX. On XX/XX/XXXX, I had a medical emergency that started in the ER of one hospital where I was diagnosed and transferred by ambulance to a different hospital for XXXX to save my life. The ensuing bills ran into hundreds of thousands of dollars, but I have made sure that I always carry reasonably good medical insurance because one of my kids has XXXX XXXX and has had his own battery of life saving operations since infancy.
Some time after I returned home, a representative, from the hospital that performed the bulk of the procedures, got in touch with us because the medical claims started being declined by our insurance company. My wife, having too much experience dealing with insurance industry bureaucracy, got in touch with our insurance provider and was able to get an explanation from them. They stated that the claims were submitted against the XXXX policy that we'd replaced three days prior to my ER visit. They blamed COVID-19 legislature for further confusing the problem because it had extended the grace period for insurance plan premiums. Unbeknownst to us, during that extended grace period, we could have reinstated the previous policy if we'd determined it better fit our new and unexpected medical situation. Nonetheless, the suggested solution was simple enough. They requested that the claims be resubmitted with the new policy number. My wife passed this information along to the hospital and any of their subcontractors who contacted us separately. With that, the reprocessed claims started getting paid.
Life went on and eventually we moved and started looking at real estate in our new community. In XX/XX/XXXX, five different collections items appeared on my credit report from the same collections agency for what I assume were three subcontractors from that one incident. What's worse, it showed that we'd agreed to five payment plans and we were late on all of them. Overnight, my credit score dropped over 100 points. Once again, my wife looked into it and eventually found that two of those five items were part of the initial claims that had been declined due to the outdated policy number. I confirmed with the insurance company that they would still process the medical claims if they're resubmitted. With this information in hand, I called the collections agency at the number that was listed in my credit report. They said they'd be able to reprocess all their claims, including the three that I told them I couldn't find records for. I shared the correct policy information with them.
I was told that it would take four to five weeks to reprocess. We put house hunting on hold as I'd periodically check the insurance website to see if I could get an update on these incoming claims and their status. A month after talking to the collections agency, my first letter from them arrived. It stated that my insurance company just wasn't paying so I should go ahead and pay the bills myself. Just in case the insurance company website wasn't showing me these claims, I got in touch with the insurance company and confirmed that the reason I couldn't see those five reprocessed claims is that no such activity was taking place.
After contacting the collections agency in good faith and putting my home purchasing plans on hold for over a month, I feel like I'm just a soft target for them to convert purchased debt into profits. I can't help but notice that the choice in how these medical collections are being reported seem to have been calculated to exact maximum negative impact on my credit. With that accomplished, they seem to just be trying to drag this along so that I reach the point where I find it easier to just pay them off. I have complained to the three credit bureaus through their online dispute websites. However, they don't appear to care since these collections items aren't the clear result of identity theft.

Hello, I recently applied for a XXXX loan to buy a house for my family. When the lender ran my credit report, I had an account from Wakefield & Associates pop up for {$3100.00} that I am completely unaware of. I decided to call them and inquire about this debt, XXXX answered my phone call, I asked for any proof that this debt was mine, any signatured documents from me, they stated, " That's not how this works. '' I explained that I will file a complaint with the XXXX and XXXX for reporting erroneous information to my credit report and limiting my credit possibilities. XXXX then stated, " That's not how this works '' again, then proceeded to tell me to " call a hospital and ask for itemized list. '' I don't have any recollection of this debt by any means. I have disputed this multiple times.
Please help remove this from my credit so I can purchase a home for my family.

Wakefield and associates has continued to harass me and told me they would ruin my credit. Every month they continue to hit my credit report, lowering my score even further. I get relentless calls and letters when I have asked them to stop. They also ignore the fact that my entire income is social security XXXX and Im barely surviving as it is. I also suspect this bill is an old medical bill that the VA is responsible for for. Im a XXXX veteran and the VA pays 100 % of my medical bills but sometimes clinics, doctors etc dont want to just thru the government hoops or file in a timely manner so they stick the debt in my credit. Ive also suffered a national natural disaster and have been XXXX since hurricane Sally XXXX XXXX. I have absolutely no means to deal with this debt. Im XXXX and on a fixed income. Im also having a hard time renting because Wakefield constantly hits my credit monthly lowering the score. Im so despondent I cant function. I need a home and a safe place to live and this company seems driven to deny me that. Please help.

I have obtained my consumer reports and seen 3 collection accounts on it from Wakefield and associates. The amounts shown on these accounts are {$1000.00}, {$1000.00} and {$430.00}. I am making you aware that my consumer rights is being grossly violated, for one, I do not know how this company obtained my consumer report as I have never done business with them, I don't have any express agreement with this company and or this alleged debt is not permitted by law which violates 15 usc 1692f ( 1 ). Secondly I have the right to priavcy and it is abusive invade a consumer privacy pursuant to 15 usc 1692 ( a ). I don't know how my private information get in this company hands but I am demanding that this company cease and desist communication with me through any and all means this is including communicating with the consumer reporting agencies pursuant to 15 usc 1692c. I am also demanding that you send a valid proof of claim, this includes but not limited to all book keeping entries and and ledger on the account so I can verify this account.

My minor child had a medical debt due to a car accident that was paid by the other parties ' auto insurance. Nevertheless, I received a notice from Wakefield & Accossiates saying I owed the debt and it would be reported to my credit report if I did not pay it. I paid it in full so that it would not affect my steller credit. One month later I received a notice in the email from them demanding payment and a threat to report negatively to the credit agencies. I called and spoke to the representative explaining that it had been paid in full, twice! He apologized and told me to disregard the notice. I have received no phone calls/ messages from them since then/mail. Yesterday, I started getting numerous amount of credit alerts, low and behold Wakefield has put this account on my credit reports as a collection. I immediately called them, they apologized and said they were fixing it with the credit agency and sending me a letter of deletion via email. I have received NOTHING. In the meantime they have caused me a hardship, my credit score has fallen for the 700 '' s to XXXX which is only a fair rating. My credit card companies want to lower my lines of credit and I can no longer continue in the search for a mortgage to purchase a home. After constant communication with this company and correction to the financial burden they have put on me, I have no choice but to demand that this be corrected immediately. This should be illegal!

For the last 3.5 years i have continuously had to monitor my credit as Wakefield & Associates, Inc keep putting totals on my reports that are not mine. I have asked many time for evidence, proof these are my debts and everytime the debts magically disappear then reappear under another collection agency. It is a game where they keep throwing it on my report and never provide. This is not my debt, i would like it removed permanently from all 3 agencies. I have never been to the medical place they list. I have even called that company and they always say they have nothing to send me but a bill which does not help. Please help me take care of this once and for all.

I had XXXX XXXX at XXXX Hospital, XXXX, FL on XXXX XXXX, XXXX. I subsequently received a bill from XXXX Hospital in the amount of {$2400.00}. However, this bill had no detail, so I immediately requested a detailed, itemized bill from the hospital. It took many months for XXXX to respond to me with such an itemized bill, which I finally received in XXXX XXXX. I immediately paid this bill in full on a Mastercard, which posted to that account on XXXX XXXX, XXXX. Unfortunately, XXXX forwarded this " unpaid '' bill to a collection agency, Wakefield & Associates, that same month. I subsequently learned that the communication between XXXX and Wakefield was not adequate, and that XXXX 's email notification to Wakefield informing them that the bill was paid went to an email account that was not monitored properly by Wakefield. Wakefield subsequently sent my name to XXXX in XX/XX/XXXX. When I became aware of this and saw my XXXX credit rating drop precipitously from XXXX to XXXX (! ), I began contacting all three parties -- XXXX Hospital, Wakefield & Associates, and XXXX -- to see how to resolve this. I was informed by Wakefield that they had since been notified the bill was paid, and that their records indicate a XXXX balance. I submitted at least 3 " Disputes '' to XXXX providing all of this information, as well as documentation from the original payment. As of today, XXXX continues to assert that Wakefield is informing them that the debt remains outstanding and my credit rating with XXXX remains damaged.

WAKEFIELD & ASSOCIATES is reporting a claim for a {$1400.00} debt as a monthly payment that is late each month. The debt ( unknown ) is 17 years old, or more and I have never agreed to make monthly payment and don't even recall what it is. Not fair to report such an old debt, that may or may not be owed, and to fake a monthly late payment when no payment arrangements have ever been discussed is wrong and it's preventing me from moving into an apartment.
This company has also figured out a way to report this same collection as 2 separate collections, just to make my score even lower. they are holding my credit hostage with false reporting. XXXX removed one of these because they recognized it as fraud.

This is a complaint about Wakefield and associates. I contested the medical debt in writing and was told they would let me know what happened with my contesting. I never received a written reply or phone call about the contesting. Instead they reported me to the credit bureau and I called them and they claimed it said it was marked as contested but wouldnt let me talk to a supervisor and said hed write it down for him. They wouldnt give me the name of the person they were trying to collect the debt for ( nurse practitioner ) or a phone number or address. They said XXXX. I provided insurance documentation and they continue to call and tell me you not paying this debt is hurting your credit. The most recent person to call had no idea I had contested this and continued to threaten my credit.

I need this resolve, under the Fair Credit Reporting Act, these disputed items may not appear on my credit report if they can not be supported by any evidence ( 1 ) In general No person ( company ) shall sell, transfer for consideration, or place for collection a debt that such person has been notified under section 1681c-2 of this title has resulted from identity theft.
( 2 ) Applicability The prohibitions of this subsection shall apply to all persons collecting a debt described in paragraph ( 1 ) after the date of a notification under paragraph ( 1 ).
( 3 ) Rule of construction Nothing in this subsection shall be construed to prohibit -- ( A ) The repurchase of a debt in any case in which the assignee of the debt requires such repurchase because the debt has resulted from identity theft ; ( B ) the securitization of a debt or the pledging of a portfolio of debt as collateral in connection with a borrowing ; or ( C ) the transfer of debt as a result of a merger, acquisition, purchase and assumption transaction, or transfer of substantially all of the assets of an entity.
A person that furnishes information to any consumer reporting agency shall have in place reasonable procedures to respond to any notification that it receives from a consumer reporting agency under section 1681c-2 of this title relating to information resulting from identity theft, to prevent that person from refurnishing such blocked information.

XX/XX/XXXX I received a letter from Wakefield and Associates stating I owed {$1200.00} from an ambulance ride to XXXX Hospital that occured earlier XX/XX/XXXX. I contacted the collection agency and disputed with them that this was not my debt. The name on the letter, the date of birth and address were NOT MINE. I have never been transported to a hospital by ambulance. I called the collection agency back twice, never received a call back and on my third attempt finally got a hold of a man and explained they contacted the wrong person. The man said he would like into it further. As of XX/XX/XXXX I now show it in collections on MY credit report.

I had an emergency at work and went to hospital which all bills were paid by XXXX XXXX XXXX XXXX. This bill I didnt receive at all because it was sent to an old address that I did not reside. It was two separate doctors bills that is separate from the hospital which I had no clue. I was able to work with one and had it paid but this one is not sending it to XXXX XXXX which they should have in the first place. They sent it to collections and I didnt know if the bill but when I called the company they got nasty and the credit service is unable to clear it up

I was never contacted by Wakefield And Associates not even when the supposed debt was transferred to them. I did not receive any written notification via mail from debtor or the collection agency. If either one had contacted me within the 1 year period after supposed date of service than I would of had the chance to submit the debt to the insurance company for payment. Since gaining knowledge of the alleged amount that I owe I have tried diligently to contact not only the debtor but also the collection agency to not only verify the debt but also to find out why it was not submitted to my insurance company or why I wasn't notified. The agent asked me for my insurance which I provided but my insurance company declined the supposed debt because it was past the 1 year mark. Now that Wakefield And Associates have taken over this debt they have not verified its authenticity and are CHARGING ME INTEREST to the tune of {$400.00} more than the debt is. I would assume that is why they have not contacted me during the time of which I could have had my insurance company investigate further the validity of the debt. I want this debt removed from credit report until the creditor/Medical company can prove the debt is valid and provide me with the documentation from where it came from.
