Citation text line | OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing their jobs duties. a. On or about and at times prior to November 11, 2023, at the tomato farm located on 8000 State Road 31, Punta Gorda, FL, 33982, employees were exposed to the hazard of high heat from the sun during the performance of their job duties, including staking and picking tomatoes. The Wet Bulb Globe Temperature (WBGT) ranged from 25.3? to 35.1? (77.7 ? to 95.2 ?) while working outdoors performing moderate to heavy manual labor and wearing long sleeves, long pants, and a hat. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. An employee experienced heat stroke during the course of his duties on or about November 11, 2023. |
