I, XXXX XXXX, have reason to believe that Bank OZK is in breach of contract, and may be implicitly committing securities fraud, banking fraud, and deposit fraud.
On XX/XX/XXXX XXXX XXXX deposited {>= $1,000,000} USD via the transfer of XXXX lawful instruments in accordance with Federal and Florida State Law. On the said date, XXXX XXXX sent the following message to Bank OZK via the email account of XXXX to XXXX, & XXXX : ATTN : XXXX XXXX Bank OZK, I, XXXX XXXX, currently wish to retitle the deposit account into the name of an Irrevocable Trust which has perfected its secured interest in the account via Trust arrangement. Additionally, I would like for XXXX funds transfer items to be processed and/or deposited as instructed via ( Exhibit 5 ) INITIAL INSTRUCTIONS section of the attached Deposit Account Control Agreement. The message was also forwarded to XXXX. Following is the exact message received : Good morning, XXXX, Just reaching out to let you know that your XXXX is still being reviewed and will update you once I hear back from our XXXX department on how to move forward.

The message was sent from XXXX to XXXX as well as XXXX & XXXX. Following are the exact words of the message : Good morning, XXXX, Thank you for taking the time to reach out to me and for your interest in our business. We really appreciate you putting your trust in our services.
Unfortunately, at this time, Bank OZK will not be able to fulfil your request with your trust account and denied the account opening.
Thank you, XXXX XXXX Banking Relationship Specialist XXXX XXXX XXXX XXXX, XXXX, FL XXXX O : XXXX NMLS # XXXX XXXX Bank OZK refusal to acknowledge and allow fiduciary authority is a breach of contract and their Terms and Conditions.
Though the message did not specifically address the {>= $1,000,000} USD deposit, nor the {>= $1,000,000} Deposit, the bank OZK refused to process the deposits. Due to their failure to process the deposited instruments into the checking account of XXXX XXXX, they are in breach of their contract with XXXX XXXX as per AQccount Disclosure Agreements which were transferred from Bank OZK to XXXX XXXX for official review on XX/XX/XXXX.
On XX/XX/XXXX XXXX XXXX provided Notification of ERROR to Bank OZK via email. The email included two attachments. One was the statement for the month of XXXX, and the second attachment is the official Notificaiton of ERROR. The body of the message contained the following words : BANK OZK, Please be advised that this is an official notice from a consumer of a BILLING ERROR.
Attached is official communications from the consumer XXXX XXXX to Bank OZK which serves as NOTIFICATION of ERROR. This NOTIFICATION is being presented to Bank OZK in accordance with The Electronic Fund Transfer Act ( EFTA ) ( 15 USC 1693 et seq. ) of 1978.
Please read the attached notification of error and review the relevant Account Statement which serves as evidence that Bank OZK is in breach of contract by its refusal to deposit authorized funds which were lawfully transferred via electronic means and were accepted by the Bank.
Refusal to provide redress by processing the electronic funds transfer within 10 days of receipt of this notice, and/or refusal to provide provisional funds in the amount of {>= $1,000,000} USD to XXXX XXXX on or before 10 days of receipt of this NOTICE may cause this matter to be presented to the Federal Trades Commission of the United States of America , the Attorney General of FLORIDA, and may cause an involuntary bankruptcy case to be filed against Bank OZK for the benefit of the consumer who is currently a Creditor Bank OZK , as evidenced via the accounting records of XXXX XXXX XXXX

On XXXX there were purchases done with my debit cards with banking institution BANKOZK located at XXXX XXXX XXXX XXXX XXXX XXXX FL XXXX. Names on the first account was XXXX XXXX XXXX, XXXX XXXX this was a joint checking account, The XXXX was checking account was in XXXX XXXX name alone.
I filed a fraud report with them on XXXX and also with our local police in saint XXXX fl.
My email address is XXXX and my address is XXXX XXXX XXXX. XXXX XXXX XXXX XXXX FL XXXX On XXXX XXXX someone posed as a BANKOZK XXXX on our phone and they informed us that someone authorized a {$1800.00}. purchased on our accounts. They instructed Us to go out and purchase gift cards in the amount totaling $ XXXX so that they could protect our XXXX accounts so they would be safe. This took place between hours of XXXX ; XXXX TO XXXX ; XXXX on XXXX XXXX what NEVER HAPPENED was our Bank Notifying us that something was wrong with both our accounts. Today XXXX, XXXX I was informed by BANKOZK that our request was denied.
The BANKOZK NEVER NOTIFIED US That day or when the decision was made about the outcome of ourcase. NOT GOOD BUSINESS!!!
I will also be contacting our local news station and our local politicians, state banking rep. also Please advise us of what way to proceed with this matter to get resolved.

On XX/XX/XXXX myself, my fianance, and the gentleman who had the loan with The Bank OZK went to the XXXX branch to pay of his XXXX XXXX motor home. We took a cashier check drawn on XXXX XXXX XXXX in the amount of {$25000.00}, a cashier check drawn on XXXX Bank in the amount of {$130000.00} and {$29000.00} in cash to pay the loan off because we were purchasing the motor home from the the indivdual who had the loan with the bank. We were told by the woman at the bank that processed the payoff that she would ask that the title be expedited because there was a ten-day hold because the monies were not wired. We were not told that if the monies had been wired we would receive the title quicker until we were leaving her office. We were told by an employee at the call center that they also do a ten-day hold on wired funds.
On XX/XX/XXXX, both cashier checks cleared the banks they were drawn, and The Bank OZK had the funds needed to satisfy the loan. On XX/XX/XXXX the man with the loan was told that the loan was satisfied and the lien had been cleared, but still they hold the title.

I zeroed out the account balance with a teller at their XXXX XXXX XXXX location and surrendered my debit card to be destroyed. My account was closed per the teller 's confirmation. I have since received overdraft fees for charges to the account, and have been informed that the account will remain open until I pay the sum of {$100.00} to the bank. I have an RV loan with Bank OZK. I recently realize that of the {$200.00} a week extra principle payments that I have been submitting, about half of them have been posted wrong thus making the current payoff higher than it should be. The only way you notice the incorrect postings is that when done correctly you see the difference in past balance and current balance is {$300.00} less. When posted incorrectly the balance only drops about {$120.00}. This over time keeps the balance higher and the payoff of the loan takes much longer.
Bank OZK says they will only go back and adjust the figures for one year. If they have made errors as a legal banking institution it would seem they have a legal obligation to make it right. I'm being told that it was my responsibility to catch the error. In other words from OZK. " let 's see how long we can get by with doing this and if we get caught we will make a few adjustments to act like we are trying to help '' I'm guessing they have a legal obligation to do correct accounting for all of their customers and not simply see what they can get away with prior to getting caught.
There are other complaints online for the same thing.

Hi. I set up a XXXX account within my bank and checking account, and ran a trial with the recipient, sending him {$1.00} on XXXX XXXX. To the same payee, I attempted to send {$700.00} on XXXX, XXXX XXXX. XXXX failed. On XXXX, XX/XX/XXXX, called up Bank OZK ( my bank ) and got, I thought, an expedited transaction of the {$700.00} being sent via XXXX to the same payee that was trialed with the {$1.00}. Bank OZK affirms that the money was sent, as does XXXX. The payee, according to him, has contacted his bank, XXXX XXXX XXXX, and states that they have no record of the XXXX transaction. I have tried, but XXXX XXXX XXXX will not talk to me. The XXXX agent stated that there was some fishy business with the payee 's cell # ( same as account # ), saying that it was unregistered from his account on XXXX XXXX and reconnected on XXXX XXXX. Now, I honestly believe that is what I heard ( telephone call ), but the agent ( XXXX ) had a rather thick accent, so I may have heard things in error. However, I don't think so. Long and short of it, I sent {$700.00} to the payee and it has disappeared. Thank you for your assistance in this matter. XXXX

I made a payment to the Bank of the Ozarks on XX/XX/XXXX of XXXX, using the portal my Home owners association/property management provides in the email they send every quarter. The payment was withdrawn from my bank account on XX/XX/XXXX .The home owners association/property management payment is considered late if received after XX/XX/XXXX.
On XX/XX/XXXX I received a letter from the home owners association/property management stating that my payment was late for XXXX. I called the accounting office on XX/XX/XXXX at XXXX and talked to the manager/supervisor and she told me, yes my payment was considered late since the payments that are made through the portal they provide from Bank of the Ozarks, the bank then sends them the ledger with the date of receiving the payment and then, posting it at their liberty could be 2-5 days after payments are made. I told the manager that my payment was made and funds withdrawn from my bank account indicating my payment was in fact made on XX/XX/XXXX at XXXX. She then told me it was my fault for not making my payment with sufficient anticipation. I told her I had the receipt stating my payment was made on time as well as the receipt of the funds withdrawn from my bank account for payment on XX/XX/XXXX. She told me that's how Bank of the Ozarks post the payments at their liberty, so I should talk them. I then asked her for the phone number that handles the posting of the payments, and she told me she couldn't provide it. And advised me to pay the late fee or I would be facing other interest charges.

I opened a CD account with Bank OZK on XXXX XX/XX/XXXX in the amount of {$40000.00}.
Bank OZK transferred the funds from my checking account at XXXX XXXX.
Bank OZK opened the XXXX account, but the money disappeared within 2-days. As of today ( XX/XX/XXXX ) they keep telling me not to worry, the money will show up after a 30-day hold. The hold ended two weeks ago, and the money is missing, no help from Bank OZK customer service.
Not sure if it's embezzlement or bank incompetency.

On the XX/XX/XXXX I opened a CD at the Bank OZK for {$5000.00}. It was for XXXX months expiring on XX/XX/XXXX. The account # was XXXX. The interest rate was XXXX XXXX.
I never received a notice that the CD was expiring. Without my knowledge on permission the CD was rolled over to one with a interest of XXXX XXXX. What a rip off. Why didn't they roll it over to the current rate?
