Citation text line OSH ACT of 1970 Section (5)(a)(1): Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: On or about June 6, 2016, at the above addressed worksite, employees were operating a powered industrial truck without wearing a seatbelt, because the seatbelt was damaged and had been rendered useless. Those employees were exposed to hazards, such as, but not limited to being struck by moving objects or falling loads; and/or crushed by forklift tipping. The powered industrial truck they operated was used to move loads/parts/equipment on an uneven terrain. Moreover, the forklift used was in need of regular maintenance, needed new tires, and was not equipped with an operator restraint system that was in good, working order.
