I received federal student loans from XXXX XXXX in XXXX. The loans were discharged/ forgiven since the school ( XXXX XXXX ) engaged in fraudulent misconduct as there was a lawsuit this company. The loans were later transferred to XXXX ( Now XXXX ) in XXXX which discontinued federal loans and only engaged in private loans from this time moving forward. Now, XXXX XXXX XXXX ( NES ) based in XXXX is charging me for one of my federal loans in that amount of {$10000.00} which was initially {$5700.00} with an added interest of XXXX and an additional fee of {$25.00}. the initial loan was federally discharged and forgiven, but in the interim between XXXX XXXX and XXXX, this information was lost. XXXX ( XXXX ) refuses to assist me and constantly transfers me to National Enterprise Systems. I can send information from the XXXX XXXX XXXX department that this loan was completely cleared. Additionally, the amount reported by NES is not showing in my credit report at all. I question if this amount is legitimate.

Your firm has failed to send the legally required validation of this debt. You have been notified that your actions are detrimental to me and that your firm has violated ( including but not limited to ) the Consumer Credit Protection Act, the Fair Credit Reporting Act, and the Fair Debt Collection Practices Act. Your firm knew or should have known that the actions taken against me and the information collected about me was inappropriate and damaging to me.

I was recently alerted by a credit monitoring service that a new collection account was placed on my XXXX credit report on XX/XX/XXXX in the amount of {$2500.00} by National Enterprise System the original creditor being XXXX XXXX. Let me start by saying, I do n't owe this debt because it was included in my chapter XXXX bankruptcy discharged of XX/XX/XXXX. I am certain XXXX XXXX was notified of my filing and discharge at the time. I have a copy of my discharge notice as proof. I was also able to contact XXXX XXXX on XX/XX/XXXX which they then confirmed my debts were sold to an outside collection agency many years ago soon after learning of my filing. XXXX XXXX forward me an old student account summary showing a balance in the amount of {$1000.00} dated XX/XX/XXXX that I allegedly owed at the time, which i disagreed with. The collection agency ( NES ) who now owns this zombie debt plus the unexplained amount they 've added on to it has re-aging this debt by recently placing it on my credit report as if it was only 4 years old.They claim I owe this amount but can not tell me why. I have worked very hard to re-establish my credit over the past 6 years and now my rights are being violated and this is beginning to cause me great stress and depression.

I filed a complaint against XXXX/XXXX through this agency the case number is OMB # XXXX. I did get a letter from NES offering a co-borrower release for {$220.00} due XX/XX/XXXX they acknowledge that they are a debt collector then say that there is {$560.00} that I owe on the account. The letter they sent me is dated XX/XX/XXXX. I spoke to someone at NES last week and I told them that I wanted XXXX or NES to remove this account from my credit report because XXXX has never accepted that I had an agreement with XXXX XXXX to pay {$48.00} a month without having to bring the account up to date from when my nephew stopped paying for 7 months. My argument is that the account should have never been sent to a collection agency since I have been paying this account since XX/XX/XXXX. Why did XXXX think this account was not going to get paid? When did I give them an indication that I was not going to finish paying this account? Today I get a call from NES and it was the rudest call ever. The representative actually called my nephew a thief!!! What business does he have saying something like that. I am a XXXX, I am a law abiding citizen, I have done nothing but try to help my nephew get a career. My nephew fell upon hard times and did n't pay on his loan, I took over payments when I found out he was n't paying. I have paid for 5 years I am not cheating anyone! He had no right to accuse my family member of anything especially since I have been making payments. Yes, I paid the XXXX payment two weeks late but I also sent the XXXX payment a week early. My father died on XXXX XXXX he was sick on XXXX XXXX, I was n't thinking about student loans - should XXXX have assumed that I would no longer pay after sending in XXXX of dollars. Should I be punished with a bad credit report because XXXX felt the need to send it to an unscrupulous company that hires people that slander my family member because they really thought I would give up making payments? Something really needs to be done, this is abusive.

I never agree to have private loans. I attended XXXX XXXX XXXX in XX/XX/XXXX and graduated in XX/XX/XXXX in XXXX XXXX.When I enrolled to this school I was informed that the school was accredited and that I could transfer my credit to other school. they said they will help with me with my job search. I remember specifically telling My recruiter XXXX that I only wanted federal loans.I never agree to have private loans and somehow they manage to include it for me. When I attended to this school I enrolled hoping that i will eventually become a professional and have a career out if this school. When i graduated and started looking for jobs I always was rejected by potential employers. I knocked so many doors but no one ever gave me an opportunity. I turned to XXXX for help and they were giving me jobs that didnt even had to do anything with what i had studied. Then i decide to continue my XXXX at another school and learnt the credit were not valid and transferable i have not been able to attend school due that i have to much debt and cant afford to continue. Currently iam not working in my field and i struggle everyday to support my family. I need help. This debt is really drowning me making me not want to live anymore. I need to dispute the validation of this debt. How can i do about that?

On the voicemail i got all the phone numbers go back to National Enterprise Systems. Then they demanded i pay them {$1600.00} by XXXX XXXX or the claim will get filed against me. After that they called my family members several times including leaving them voicemails to and sending documents about this matter to them, which should be in violation. I had stated on the phone with them not to call my family members and they deny that they called. I have all the proof phone numbers voicemails everything. They will not tell me anything else about this debt only that i have to pay today or that all other options will be forfeited. And that they have been instructed to contact my employer,

In XXXX XXXX 2017, I was notified via my employer of a wage garnishment I was not aware of. I did research in an effort to find out exactly what had occurred. I went to the payroll department to find a letter, not a court order for garnishment of wages. In the letter, the following Federal law was quoted : 102-164. Upon further inquiry, it is a company called National Enterprise Systems. They were garnishing me without notification or any means of making arrangements to settle the debt. I have never heard of this company. Do I have students loans? Absolutely. I am currently in contact with those debtors. The amount of money they are taking out has caused grave consequences to my family. I am currently not able to provide for my children, I have XXXX and I also help my elderly parents which I have been providing assistance to. They are garnishing close to {$500.00} per month. I am not able to pay my rent in XXXX. I received a copy of the letter today from my employer thinking it was a court order which gives consumers the right to respond and settle the debt. It is not a court order, but a letter which I have attached. I am unable to survive with this kind of money being deducted from my account without sufficient notification to settle this dispute.
The letter is attached which was obtained today. I contacted them with the number retrieved from the letter trying to find validity.
Based on the law they quoted, the following did not occur. : ( 2 ) the individual shall be provided written notice, sent by mail to the individuals last known address, a minimum of 30 days prior to the initiation of proceedings, from the guaranty agency or the Secretary, as appropriate, informing such individual of the nature and amount of the loan obligation to be collected, the intention of the guaranty agency or the Secretary, as appropriate, to initiate proceedings to collect the debt through deductions from pay, and an explanation of the rights of the individual under this section ; ( 3 ) the individual shall be provided an opportunity to inspect and copy records relating to the debt ; ( 4 ) the individual shall be provided an opportunity to enter into a written agreement with the guaranty agency or the Secretary, under terms agreeable to the Secretary, or the head of the guaranty agency or his designee, as appropriate, to establish a schedule for the repayment of the debt ; ( 5 ) the individual shall be provided an opportunity for a hearing in accordance with subsection ( b ) on the determination of the Secretary or the guaranty agency, as appropriate, concerning the existence or the amount of the debt, and, in the case of an individual whose repayment schedule is established other than by a written agreement pursuant to paragraph ( 4 ), concerning the terms of the repayment schedule ; ( 6 ) the employer shall pay to the Secretary or the guaranty agency as directed in the withholding order issued in this action, and shall be liable for, and the Secretary or the guaranty agency, as appropriate, may sue the employer in a State or Federal court of competent jurisdiction to recover, any amount that such employer fails to withhold from wages due an employee following receipt of such employer of notice of the withholding order, plus attorneys fees, costs, and, in the courts discretion, punitive damages, but such employer shall not be required to vary the normal pay and disbursement cycles in order to comply with this paragraph ; ( 7 ) if an individual has been reemployed within 12 months after having been involuntarily separated from employment, no amount may be deducted from the disposable pay of such individual until such individual has been reemployed continuously for at least 12 months ; and ( 8 ) an employer may not discharge from employment, refuse to employ, or take disciplinary action against an individual subject to wage withholding in accordance with this section by reason of the fact that the individuals wages have been subject to garnishment under this section, and such individual may sue in a State or Federal court of competent jurisdiction any employer who takes such action. The court shall award attorneys fees to a prevailing employee and, in its discretion, may order reinstatement of the individual, award punitive damages and back pay to the employee, or order such other remedy as may be reasonably necessary. Based on the law provided in their letter, not court order the following information is stated : I was never contacted via phone, mail, email or any other entity. If they were able to acquire my employment information, surely they could have contacted me if they had no way of contacting me. None of this occurred. I am not able to pay basic bills with this wage garnishment. I 'm am behind on basic needs after 3 garnishment deductions. Help is desperately needed in this matter.
( b ) Hearing requirements A hearing described in subsection ( a ) ( 5 ) shall be provided prior to issuance of a garnishment order if the individual, on or before the 15th day following the mailing of the notice described in subsection ( a ) ( 2 ), and in accordance with such procedures as the Secretary or the head of the guaranty agency, as appropriate, may prescribe, files a petition requesting such a hearing. If the individual does not file a petition requesting a hearing prior to such date, the Secretary or the guaranty agency, as appropriate, shall provide the individual a hearing under subsection ( a ) ( 5 ) upon request, but such hearing need not be provided prior to issuance of a garnishment order. A hearing under subsection ( a ) ( 5 ) may not be conducted by an individual under the supervision or control of the head of the guaranty agency, except that nothing in this sentence shall be construed to prohibit the appointment of an administrative law judge. The hearing official shall issue a final decision at the earliest practicable date, but not later than 60 days after the filing of the petition requesting the hearing.

Now the question is, Where 's the money if it was not used with my loan, if fedloan does n't have it, who can respond to that? Yesterday, I received a letter of another third party company, trying to do the same National Enterprise System d id to me and still is doing, now the third company that want 's my money is, " XXXX '', asking for the same amount, really? This Third company needs to be stopped and I mean all third Party company. This loan went into default. I have made several attempts to contact the case manager who if she isnt there I end leaving a voicemail that never gets returned. Then if I do get her on the phone shes rude and will not negotiate with me. In the past 6 months Ive offered amounts from {$250.00} a {$2000.00} just to pay up front and then setup a payment plan for the remaining balance. She is absolutely unwilling to accept anything less than {$4000.00}. I would ask her what my options are to negotiate with them, and her response is to take out a second mortgage on my home or withdrawal funds from my 401k at work! So I appropriate!! When Ive asked multiple times to negotiate something to setup an automatic debt she ends up hanging up on me. Then when I ask the company for another case manager, they just route me back to her. When I ask for a manager, I get routed to her again! I would think a company would take any amount of money to at least begin the automatic debt process.
