|
Description |
Miscellaneous Motion Granted (OG999) ~ Upon further consideration, this Court grants the appellee’s motion for reconsideration of this Court’s December 18, 2017 order. Although the late-filed transcript by the appellee arguably prejudiced the appellant in the preparation of its initial brief, we note that the appellant made no attempt to amend its initial brief until after the answer brief was filed and the answer brief noted the failure to raise, and thus the waiver of, arguments not raised in the initial brief. The subject transcript was filed in the trial court on July 17, 2017, the initial brief was filed on July 22, 2017, the appellant moved to supplement the record and filed the transcript in this Court on September 18, 2017, this Court granted the motion to supplement on September 19, 2017, and the answer brief was not filed until October 11, 2017. We, therefore, grant the motion to strike the reply brief with leave to file an amended reply brief. The amended reply brief shall be limited to fifteen (15) pages.
