29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met: On or about May 9, 2016, and at times prior thereto, at the above addressed worksite, the employer did not develop and implement a written hazard communication program for employees performing pressure washing and painting, and were required to work with hazardous chemicals, such as, but not limited to, Vinyl Acrylic Traffic Paint, Super Spec HP Alkyd Metal Primer P06, Rust Destroyer, Gasoline, Super Spec HP DTM Alkyd Semi-Gloss P24, Crown Paint Thinner and Mineral Spirits. |

29 CFR 1904.29(a): A log of all Work-Related Injuries and Illnesses (OSHA Form 300) and for the Summary of Work-Related Injuries and Illnesses (OSHA Form 300-A), and/or the Injury and Illness Incident Report (OSHA Form 301) or equivalent forms were not kept by the establishment: a) On or about May 9, 2016, at the above addressed worksite, the employer failed to record workplace injuries or illnesses and thus, kept neither a log of all Work-Related Injuries and Illnesses (OSHA Form 300) nor the Summary of Work-Related Injuries and Illnesses (OSHA Form 300-A), nor the Injury and Illness Incident Report (OSHA Form 301) nor equivalent forms. On or about March 23, 2016, while painting gas pipes in the boiler room between 1980 S Ocean Drive and 1950 S Ocean Drive in Hallandale, FL 33009, an employee fell off from a 6-foot ladder and sustained a left knee injury. This injury resulted in a job transfer due to job restrictions which prevented the injured employee from carrying out all of the routine functions of his job. Thus, this injury met the general recording criteria, and therefore was a recordable. |
