Description |
ORDERED that, within ten (10) days from the date of this order, Appellants shall file in this court a brief statement explaining the basis for this court's subject matter jurisdiction over the order appealed in this case, citing supporting legal authorities. Appellants shall specifically address how the March 23, 2024 "Order on Plaintiff's Motion for Final Summary Judgment in his Favor and Against Defendant Cambridge Diagnostic Products, Inc." is a final or nonfinal appealable order, as it appears to merely deny a motion for final summary judgment, indicating that future judicial labor is anticipated. See Fla. R. App. P. 9.110, 9.130(a)(3); Caufield v. Cantele, 837 So. 2d 371, 375 (Fla. 2002) ("A final judgment is one which ends the litigation between the parties and disposes of all issues involved such that no further action by the court will be necessary."); Monticello Ins. Co. v. Thompson, 743 So. 2d 1215, 1216 (Fla. 1st DCA 1999) ("without language in the order which 'hereby enters' a judgment, or similar unequivocal language of finality . . . we do not possess jurisdiction."); Rios v. Miami's Garage, Inc., 217 So. 3d 232, 234 (Fla. 3d DCA 2017) ("An order denying a motion for summary judgment does not fall within any of the categories as appealable, non-final orders set forth in Rule 9.130(a)(3). Accordingly, we dismiss the appeal for lack of jurisdiction.) (internal citation omitted). Further, Appellee may file a response within ten (10) days of service of that statement.
