Description ORD-GRANT MOTION FOR REVIEW ~ The appellant's motion for review of order denying stay is granted only to the extent that this court has reviewed the trial court's order. That order is approved.Within 15 days of the date of this order the appellant shall show cause why this appeal should not be dismissed as from nonappealable nonfinal orders or as untimely.Underlying the appellant's first challenged order, the trial court's October 16, 2019, "order denying father's verified motion to set aside/vacate this court's order . . . ," the appellant filed on August 5, 2017, a motion for temporary fees. The trial court denied that motion in a nonfinal order signed on May 2, 2019. The appellant challenged that nonfinal order with the motion directly underlying the order on appeal, filed pursuant to Florida Family Law Rule of Procedure 12.540(b). However, a motion filed under this rule may not be used to challenge a nonfinal order, and this court has no jurisdiction over an order on such a motion. See Fla. Fam. L. R. P. 12.540(b) (". . . a court may relieve a party . . . from a final judgment, order, or proceeding . . ."); Mortellaro & Sinadinos, PLLC v. Countrywide Home Loans, 14 So. 3d 278, 279 (Fla. 1st DCA 2009) ("Because the December 12, 2008 order [on appeal] denied a motion to vacate a previous nonfinal order, it does not qualify as an order under rule 1.540 and it is not appealable under rule 9.130(a)(5).").The appellant's second order on appeal is merely an order denying a motion for rehearing of the order described in the previous paragraph. The court has no separate jurisdiction over such an order. Underlying the appellant's third challenged order, the trial court's October 31, 2019, "order denying father's amended motion for modification, rehearing, reconsideration, and/or clarification . . . ," the trial court on June 27, 2019, approved a magistrate's recommended rulings on the appellants several interlocutory motions. As the June 27 order was a nonfinal order, the appellant's "motion for modification, rehearing . . ." did not toll rendition of that order, such that the November 14, 2019, notice of appeal was not timely filed as to the June 27 order. See Richardson v. Watson, 611 So. 2d 1254, 1255 (Fla. 2d DCA 1992) ("Unlike an authorized and timely motion directed to a final order, a motion for reconsideration or rehearing of a nonfinal order does not toll the time for filing a notice of appeal . . . ."); Fla. R. App. P. 9.130(b).
