OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that operators of hydraulic brake presses were exposed to amputation hazards: a) For the Central Maintenance and Welding establishment at 2620 E. Keysville Rd., Lithia, FL 33547, an accident occurred on 03/26/2015 resulting in the amputation of an employee's right ring finger when an employee was rotating a die for a hydraulic brake press. The employer failed to provide the following: 1. Safe operating procedures explaining how to safely rotate multi-sided dies for hydraulic brake presses. The employer allowed employees routinely placed their hands in areas where dies, weighing hundreds of pounds, could crush them. 2. A safe design for the brackets holding dies up. The hole/notch where their bolt was affixed was larger in diameter than the bolt head. This resulted in the possibility that the bracket could slip off of the bolt head. 3. A procedure to inspect the bolts holding dies up via brackets. The bolts were deformed and loose. 4. A procedure requiring that the task of die rotation was carried out by at least two employees to render assistance as needed. 5. A protective barrier or mechanism for safely rotating the die to prevent employees from being exposed to crushing hazards from a falling die. 6. A procedure for safely changing dies. |
