On or about March 3, 2015, the storage mezzanine above in the processing building did not have complete guardrails. Employees stowing and retrieving packaging materials were exposed to a 9 feet fall hazard from the mezzanine floor to the concrete processing floor due to the nearly 35 feet of unprotected edges of the mezzanine. b. On or about March 3, 2015, employees accessing the rooftop via the catwalk above the blast freezer were exposed to an 11 feet fall hazard due to incomplete guardrails along the catwalk. c. On or about March 3, 2015, employees working from the condenser platforms and catwalks were exposed to an 8 feet fall hazard at the two floor openings between the three condenser banks that were not covered and did not have guard rails. d. On or about March 3, 2015, employees accessing the rooftop ice machines via condenser catwalks were exposed to a 15 feet fall hazard from the unprotected edge of the roof by the condensers that did not have guardrails. e. On or about March 3, 2015, employees working at the rooftop ice machines were exposed to a 20 feet fall hazard from the upper roof in that there were no guardrails. |

29 CFR 1910.119(d)(3)(i): The employer did not compile information pertaining to the equipment in the process a. On or about March 3, 2015, the ventilation for the non-electrically classified ammonia engine room location had not been designed and installed in accordance with ANSI/IIAR-2, paragraph 13.3 requirements for ventilation capacity, actuation, inlet source, discharge, and control requirements to exhaust potential accumulations of ammonia refrigerants in the event of a leak in order to minimize human exposure and flammable concentrations. b. On or about March 3, 2015, the employer did not maintain documentation for pressure vessels of the ammonia refrigeration system as required in the American National Standards Institute/International Institute of Ammonia Refrigeration, ANSI/IIAR-2 Equipment, Design, and Installation of Ammonia Mechanical Refrigerating Systems and in the Provisions of the ASME Boiler and Pressure Vessel Code Rules, Section VIII, Division 1, in that there were no Manufacturer's Data Reports, Form U-1's, for the High Pressure Receiver tanks, Recirculator vessels, oil pots, or evaporator surge tanks, and the High Pressure Receivers, negative 45 degree Recirculator, and negative 10 degree Recirculator had no manufacturers nameplates. c. On or about March 3, 2015, the pressure relief valves (PVR) protecting the pressure vessels and compressors of the ammonia refrigeration system did not have proper documentation in that the employer did not maintain the Form U-1 for each PRV, and the PVR installation dates had not been marked or recorded as required by the Provisions of the ASME Boiler and Pressure Vessel Code Rules, Section VIII, Division 1 and the American National Standards Institute/International Institute of Ammonia Refrigeration, ANSI/IIAR-2 Equipment, Design, and Installation of Ammonia Mechanical Refrigerating Systems. d. On or about March 3, 2015, in the 13,000 pound anhydrous ammonia refrigeration system, the pressure relief valves (PRV) installed on all compressors and pressure vessels had not been sized by a qualified engineer, and the pressure relief valve to discharge piping and manifolds had not been sized properly in accordance with section 11 of the American National Standards Institute/International Institute of Ammonia Refrigeration, ANSI/IIAR-2 Equipment, Design, and Installation of Ammonia Mechanical Refrigerating Systems. |

On or about March 3, 2015, no ammonia detection system had been installed in the ammonia engine room in accordance with ANSI/IIAR-2, section 13.2 and the ANSI/ASHRE Standard 15 paragraph 8.13.2 requirements for ammonia refrigerant detections systems capable of providing warning alarm signaling and ventilation actuation. b. On or about March 3, 2015, no alarm system was installed in the ammonia engine room to alert potentially exposed employees of an ammonia release as required by ANSI/IIAR-2 paragraph 13.2.1. c. On or about March 3, 2015, the walls and doors of the ammonia engine room were not tight fitting as required by ANSI/IIAR-2 section 13.1.1.3. d. On or about March 3, 2015, there were no eyewash or deluge showers outside the ammonia engine room exit doors as required by ANSI/IIAR-2 section 13.1.6.1. e. On or about March 3, 2015, the ammonia engine room exit doors were not equipped with panic hardware door releases as required by ANSI/IIAR-2 section 13.1.10.3. f. On or about March 3, 2015, an emergency shutoff switch was not located outside the ammonia engine room exit doors as required by ANSI/IIAR-2 section 13.1.13.2. g. On or about March 31, 2015, pressure vessel relief to atmosphere piping discharge points were not in accordance with the ANSI/IIAR-2 standard for Equipment, Design, and Installation of Ammonia Mechanical Refrigerating Systems section 11.3.6, specifically: 1. At the processing building, the ammonia pressure relief valve piping vent for the spiral freezer's recirculator vessel was located less than 15 feet from personnel work areas and less than 15 feet from and exit door. 2. At the ammonia High Pressure Receiver tanks, the pressure relief valve vents were located at head and shoulder level in a work area less than 20 feet from an exit door and directly beneath the condenser platform walkway. 3. At the processing building, the ammonia pressure relief valve piping vent for the brine chiller surge tank was located less than 15 feet from personnel work areas. 4. At the ammonia purger unit shack, the pressure relief valve vent was located directly inside the shack. h. On or about March 3, 2015, in the ammonia engine room, at the V-2 intercooler, and in the Spiral Freezer machinery room, oil removal fixtures for oil pots were not equipped with self-closing or quick closing valves at the oil drain points as required by the American National Standards Institute/International Institute of Ammonia Refrigeration, ANSI/IIAR-2 Equipment, Design, and Installation of Ammonia Mechanical Refrigerating Systems section 14.2.3 to prevent inadvertent or uncontrollable release of ammonia following oil drainage. i. On or about March 3, 2015, throughout the 13,000 pound anhydrous ammonia refrigeration system, ammonia piping and valves were not labeled for flow direction or pipe contents as required by Section 10.6 of the ANSI/IIAR-2 standard for Equipment, Design, and Installation of Ammonia Systems and in chapter 11 of the American Society of Heating, Refrigeration, and Air Conditioning Engineers Standard, ASHRAE-15 Safety Code for Mechanical Refrigeration. |

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a. On or about March 3, 2015, in the ammonia engine room and in the spiral freezer, employees were required to wear a full face piece respirator when working with ammonia refrigeration equipment. The employer did not implement a written respiratory protection program that addressed the worksite-specific procedures such as but not limited to employee fit testing, and training on the use, maintenance and care of the respirators. The employer did not implement and administer an effective respiratory protection program in that they did not: 1) Designate a program administrator to oversee the respiratory protection program in accordance with 29 CFR 1910.134(c)(3); 2) Provide a medical evaluation to determine the employees ability to use a respirator in accordance with 29 CFR 1910.134(e)(1); 3) Ensure that an employee using a tight-fitting face-piece respirator is fit tested prior to initial use of the respirator in accordance with 29 CFR 1910.134(f)(2); and 4) Provide effective training to employees who are required to use respirators in accordance with 29 CFR 1910.134(k). |
